Charlotte, North Carolina November 12, 1984

Dethorne Graham, who has diabetes, is about to have an insulin reaction.

He has his friend, William Berry, drive him to a nearby convenience store to get some orange juice to counteract the reaction.

Once he gets inside, he sees a really long line, making the store not so convenient anymore, and rushes back out to the car, directing his friend to drive him somewhere else to get the sugar he needs.

Meanwhile, someone across the street is watching them.

That someone is M.S. Connor, a police officer who was a bit uneasy about what he just witnessed.

To him, it looked like Graham was robbing the convenience store, based on the fact that he entered and exited the store so quickly in what seemed to be a getaway car.

Officer Connor immediately followed Graham and Berry's car, flashing the patrol lights to pull them over about half a mile away from the store.

As Connor approached the car, Berry frantically told him that Graham was a diabetic and he needed sugar immediately.

Not believing him, Connor told the two to wait while he tried to figure out what happened back at the store.

As Connor called for backup in his patrol car, Graham got out of the car, ran around it twice, and collapsed on the curb, passing out.

Connor handcuffed Graham.

By the time the backup, which was four other cops, arrived, Graham had regained consciousness.

The cops seemed to assume that Graham was just drunk.

Some of them didn't believe Graham had diabetes.

When Graham pleaded with them to check his wallet for a diabetic identification card, one of the officers told him to "shut up" and slammed him down on the hood of the car.

The officers roughed up Graham pretty badly, throwing him head first into the patrol car.

Later Graham claimed they gave him a bunch of cuts and bruises, injured his shoulder, and even broke his foot.

As Graham waited in the back of the patrol car, a friend came by with some orange juice for him.

However, the officers didn't let him have it!

Eventually, Officer Connor got a report that Graham had done nothing wrong at the convenience store, and the officers drove him home and released him.

NO HARD FEELINGS, MAN. SO WE'RE COOL, RIGHT?

Well, no, we are not cool.

Graham later sued the five involved police officers, as well as the city of Charlotte.

Graham argued his constitutional right to be free from excessive force had been violated.

The district court used a due process test from a case known as Johnson v. Glick to determine if the officers were acting out of "good faith" or just acting "maliciously or sadistically."

In other words, were the cops trying to keep order or were they abusing their power?

The district agreed with the city, justifying the actions of the police officers.

Graham appealed to the Court of Appeals for the Fourth Circuit, which agreed with the lower court.

Graham appealed again, and the Supreme Court agreed to hear the case in October 1988, almost four years after the incident.

Because Graham claimed his Fourth Amendment rights were violated, the Court had to make a decision based on how reasonable it was for the cops to do what they did strictly based on the Fourth Amendment.

Because "objective reasonableness" could be interpreted in many many ways, the Court concluded such a case would be better judged from the perspective of the officers on the scene.

On May 15, 1989, the Court announced they were unanimously in favor of Connor.

The Court told the Fourth Circuit to look at the case again through the lens of the Fourth Amendment.

They argued that doing that would make subjective concepts like malicious intent inapplicable.

Therefore, Connor was reasonably justified to assume that Graham had broken laws.

Because Connor believed a crime probably happened given the circumstances, he was not held liable because his actions were reasonable assuming the crime actually happened.

Graham v. Connor set the precedent that an "objective reasonableness" standard should always apply when somebody claims a cop used excessive force.

The case has simply made it seem more ok for cops to assume the worst, to assume they are dealing with a criminal.

Ultimately, this has led to stuff like the "reasonably scared cop rule."

This means that now police officers can fairly easily justify the use of force when their own lives are in danger.

It can be a slippery slope, when "objective reasonableness" can be easily turned into, well, "subjective reasonableness."

Police officers have incredibly difficult jobs, often making life and death decisions in a split second.

Due to this, with this case the Court basically determined that reasonable assumptions are ok to let cops do their job.

Unfortunately, cops "doing their job" has had horrible unintended consequences.

Many Americans have been abused or even died because of excessive force by the police, and it's often justified in court.

This is why the Graham decision is more relevant today than ever.

And even if you've got a hard time, you may have a friend whose initials are D and T, or T and D, for example.

I'm suggesting another way to remember it : the /ɪd/ ending is happening when the verb ends

In which cases is the -ED pronounced /t/ ?

Well, wait a minute, I think that, before speaking about that it would be better to see what's the difference

between a voiced consonant and an unvoiced consonant.

So, what's the difference between a voiced consonant and an unvoiced consonant ?

The difference between a voiced consonant and an unvoiced consonant is very simple :

You will use your voice, or in other terms, your vocal cords to do a voiced consonant, and you won't

use your vocal cords to do unvoiced consonants.

To realise it, I'm suggesting a little experiment for you.

Place one of your hands at your throat, like this, and do /vvvvvvvvvvvvvvvvvv/

Then, do /ssssssssssssss/

Not /sə/, but /ssssssssssssssss/

Then, you will realise that your hand vibrated when you did the /v/, but on the other hand (so to speak), it didn't

vibrate when you did the /s/.

That is because v is a voiced consonant, when the s is an unvoiced consonant.

A voiced consonant is in fact an unvoiced consonant for which we use our voice.

To realise that, I'm inviting you to reproduce the experiment by putting your hand on your throat.

Then, you're going to do the /f/ sound, followed by the /v/ sound, like this : /ffffffffffffffvvvvvvvvvvv/

And you will realise that your mouth didn't really move,

The only thing that changed was the usage of your voice.

So, in which cases will we pronounce this fudging ending /t/ ?

So, we'll pronounce the -ED /t/ when following an unvoiced sound, except for the /t/,

since in this case, we saw that it's pronounced /ɪd/.

To remember it, it's very simple, just remember that the /t/ sound is unvoiced,

just as the sound it's supposed to follow.

So, /t/ pronunciation will follow sounds like /f/, /s/, /p/, /k/, /ʃ/ and /θ/.

Well, that's not a lot, and we'll find it in verbs like : kissed, laughed, typed, kicked,

pushed, birthed, watched, mixed.

I see you coming to tell me that I forgot the x for mixed. Yeah, but no, because

in fact, technically, phonetically speaking, a x is nothing more than a /ks/.

So mix ends with an /s/ sound.

And same thing for watched, we do have the /tʃ/ sound, but, in fact, it is /tʃ/, so it ends with an /ʃ/ sound.

Yeah, there you are, it's better to reduce as possible...

Then, in which cases do we pronounce this ending /d/ ?

The last pronunciation, /d/, is happening in all the other cases...yeah, necessarily...

But since you're asking, the -ED ending is pronounced /d/ when the sound

that precedes it is voiced. So, we're going to find there all the voiced consonants as well as vowels.

But if it can help remembering, the /d/ pronunciation is voiced, just as well as the sound it follows.

So, when we've got a voiced consonant, it will be voiced, and when we've got an unvoiced consonant,

I'm suggesting another way to remember it : the /ɪd/ ending is happening when the verb ends

by the two other ways to prononce it.

Basically, three ways to pronounce the -ED : /d/, /t/ and /ɪd/. And /ɪd/ happens when the verb ends with

one of the other ways to pronounce it.

So, we'll find this pronounciation in verbs like Started, Decided ar even Needed.

In which cases is the -ED pronounced /t/ ?

Well, wait a minute, I think that, before speaking about that it would be better to see what's the difference

between a voiced consonant and an unvoiced consonant.

So, what's the difference between a voiced consonant and an unvoiced consonant ?

The difference between a voiced consonant and an unvoiced consonant is very simple :

You will use your voice, or in other terms, your vocal cords to do a voiced consonant, and you won't

use your vocal cords to do unvoiced consonants.

To realise it, I'm suggesting a little experiment for you.

Place one of your hands at your throat, like this, and do /vvvvvvvvvvvvvvvvvv/

Then, do /ssssssssssssss/

Not /sə/, but /ssssssssssssssss/

Then, you will realise that your hand vibrated when you did the /v/, but on the other hand (so to speak), it didn't

vibrate when you did the /s/.

That is because v is a voiced consonant, when the s is an unvoiced consonant.

Did you knew ?

A voiced consonant is in fact an unvoiced consonant for which we use our voice.

To realise that, I'm inviting you to reproduce the experiment by putting your hand on your throat.

Then, you're going to do the /f/ sound, followed by the /v/ sound, like this : /ffffffffffffffvvvvvvvvvvv/

And you will realise that your mouth didn't really move,

The only thing that changed was the usage of your voice.

So, in which cases will we pronounce this fudging ending /t/ ?

So, we'll pronounce the -ED /t/ when following an unvoiced sound, except for the /t/,

since in this case, we saw that it's pronounced /ɪd/.

To remember it, it's very simple, just remember that the /t/ sound is unvoiced,

just as the sound it's supposed to follow.

So, /t/ pronunciation will follow sounds like /f/, /s/, /p/, /k/, /ʃ/ and /θ/.

Well, that's not a lot, and we'll find it in verbs like : kissed, laughed, typed, kicked,

pushed, birthed, watched, mixed.

I see you coming to tell me that I forgot the x for mixed. Yeah, but no, because

in fact, technically, phonetically speaking, a x is nothing more than a /ks/.

So mix ends with an /s/ sound.

And same thing for watched, we do have the /tʃ/ sound, but, in fact, it is /tʃ/, so it ends with an /ʃ/ sound.

Yeah, there you are, it's better to reduce as possible...

Then, in which cases do we pronounce this ending /d/ ?

The last pronunciation, /d/, is happening in all the other cases...yeah, necessarily...

But since you're asking, the -ED ending is pronounced /d/ when the sound

that precedes it is voiced. So, we're going to find there all the voiced consonants as well as vowels.

But if it can help remembering, the /d/ pronunciation is voiced, just as well as the sound it follows.

So, when we've got a voiced consonant, it will be voiced, and when we've got an unvoiced consonant,

it'll be unvoiced.

So, we'll find the /d/ pronunciation after sounds like /b/, /g/, /l/, /m/, /n/, /r/, /v/, /j/, /z/

or even /ð/.

We'll find this ending in words like earned, bagged, pulled, hummed, scored, lived,

snowed, played, used.

So, just a tip : There are so many of them, no need to remember them all,

Just remember that if you're not in presence of one of the 2 other cases, then, you're necessarily in this one.
