Supreme Court Briefs

Omaha, Nebraska, 1985

A group of students at Westside High School wants to form a Christian Bible Study Club that would meet after school, but on school grounds.

One of the students, Bridget Mergens, asks the principal, James Finley, if they can do so, but he says no, saying the school could not allow a staff member to sponsor it.

So Mergens and the rest of the students took the school district, Westside Community Schools, to court

saying the district broke the Equal Access Act, a law passed the previous year that required secondary public schools to provide equal access for its students to all extracurricular clubs.

The students argued that denying the bible study club went against the Establishment Clause of the First Amendment to the Constitution.

The U.S. District Court for the District of Nebraska ruled in favor of the school district, arguing the district did not violate First Amendment nor Fourteenth Amendment rights.

They also said the district didn't break the Equal Access Act.

The students appealed to the 8th U.S. Circuit Court of Appeals, which reversed the decision of the lower court.

While the Court of Appeals said the Equal Access Act could have been written better, it said it was constitutional.

More importantly, it said the district was taking away the students' First Amendment rights by not allowing them to meet on school premises during "non-instructional time."

Westside Community Schools appealed to the Supreme Court.

The core issue was whether or not the Equal Access Act violated the Establishment Clause of the First Amendment by its requirement that schools allow clubs not related to stuff being taught in schools.

Were religious clubs protected under that as well?

The Court heard oral arguments on January 9, 1990, but it wasn't until June 4 that they decided.

In an 8-1 decision, the Court sided with Mergens and the rest of the students, saying the Bible Study Club could meet, but that their sponsor could not get paid for it.

If the sponsor got paid, this might seem like an endorsement of one religion, which would break the Establishment Clause.

It upheld the Equal Access Act.

It also said that when public schools allow any clubs- including those that have little to do with what's being taught in classes at the school- meet on school grounds, they have to open it to all clubs, religious or not.

Justice Sandra Day O'Connor wrote the opinion.

"Allowing students to meet on campus and discuss religion is constitutional because it does not amount to 'state sponsorship of a religion."

Westside Community Board of Education v. Mergens didn't settle the separation of church and state issue for sure, but it did settle the right for students to use public facilities to talk about their religion, as long as it wasn't part of the regular curriculum.

In recent years, atheist clubs have popped up in high schools across the country, and people have been offended.

But guess what?

They have the right to do that thanks to this case.

3 Christmas DIYs made from Ping Pong Balls! - HGTV Handmade - Duration: 7:20.

Hi guys, welcome back to HGTV Handmade.

I'm Karen Kavett and today I've got 3 Christmas DIYs for you all using a really

cheap, really common item - a ping pong ball.

Well, a lot of ping pong balls.

Ok, so here's what happened.

Earlier this year I made the DIY Foosball game here on Handmade, it came out so good.

Obviously I needed a ping pong ball to be able to play the game, but I didn't have

any.

So I went online, ordered some, and I ended up with 144 ping pong balls.

They were really cheap, but like, I only needed one for the game, so the rest of them have

just been sitting there.

So today I am finally going to use them.

I came up with three DIY ideas using all of these ping pong balls.

Let's get started.

So first up is an adorable snowman ornament.

You'll need two ping pong balls, and begin by taking one of them and cutting a hole in

the top and the bottom.

Then use hot glue to glue it to the second one.

Now to make the hat, you'll need black felt.

Cut a piece that measures about 1 inch by 12 inches.

Then roll it up and secure the end with hot glue.

Now trace that piece and a roll of washi tape to get one small circle and one large circle.

Thread a piece of string through a needle and sew a loop onto the smaller circle to

make the hanger.

Now glue the circles to the top and bottom of the roll of felt to make a mini top hat.

And then glue that to the top of your snowman.

To make the arms, you'll need two toothpicks.

Cut one of them in half and the other into fourths.

Then use a small dot of hot glue to glue them into a Y shape.

Once that's dry, use a thumbtack to make a hole on each side of the snowman and stick

the arms in there.

Then to make the nose, I'm using a wooden skewer.

Use heavy duty scissors to cut off the pointy bit on the end.

And then use an orange marker to color it so it looks like a carrot.

Use another dot of hot glue to glue it in place.

And finally, it's time to decorate your snowman however you like.

I'm using the back of a paintbrush to add dots, but if you have kids, adding the face

could be a fun activity for them.

And that's it.

That's how you make an easy snowman ornament using stuff you probably already have.

Either go traditional like I did with these or you can go crazy with your colors and decorations.

Next we're going to make these beautiful marbled ornaments.

Begin by sticking a toothpick into a ping pong ball, so that it almost looks like a

lollipop.

Then fill up a cup with room temperature water and drip in a few drops of nail polish.

Dip the ping pong ball into the water, and in seconds, you've got a gorgeous marbled

ornament.

Just lay it down on wax paper to dry.

So here are a few tips.

A little nail polish goes a long way, so you only need a few drops per ornament.

When you're done with one color, make sure that you dump the water out immediately, because

if you let the nail polish sit in a plastic cup, it'll eventually eat away at the plastic

and you'll get water literally everywhere.

I found that out the hard way.

I also found that darker colors of nail polish work best, since light colors don't really

show up.

And you can experiment with mixing multiple colors to get different patterns.

So once they're completely dry, we just need to turn them into actual ornaments.

Remove the toothpick and grab a cheap earring hook.

Bend it so you can remove the spring and you can add another bead if you want to.

Then stick that into the hole from the toothpick and add a dot of hot glue to keep it in place.

And finally, tie a hanger out of a piece of string.

And that's it.

I think these came out so cool and I cannot believe that we made them from regular old

ping pong balls.

And finally, I've still got quite a few ping pong balls left over, so I'm going

to make a garland for my tree.

To do this you'll need embroidery thread and a large sewing needle.

Just make sure the needle is longer than your ping pong balls.

Tie a knot on one end of your string and thread the other end into the needle.

Then stick the needle through to thread the ping pong balls onto the string.

If you have trouble pulling the needle all the way through, I found it helped to use

a grippy jar opener from the kitchen.

And that's it.

You can make this as long as you want and then just tie off the other end.

This is such a simple idea but I think it looks so good on my tree and it's really

quick to make.

He's been practicing it. Rabona always looks good.

He has the darkness and coldness of the autumn against him, but he's practicing. That's right.

Skilful stuff. What else? Rabona.

Yeah. That deserves a double thumbs up.

He seems to be a leftie.

It looks beautiful when you can do it right.

That was another textbook example of the knuckle.

More shots. This time to a moving ball.

A sweet shot to the top bin. Nice outside curve.

I think a candy man would be a good name for him after that.

Then freestyle. Good variation.

Dude's ballin with a silky touch.

Back to the pitch.

Nice shot. The ball makes a lovely sound when you hit it right.

A different kind of pitch.

It's not once or twice that's happened to me too.

Is he going to shoot?

Nice knuckle. You could see the keeper standing like this and the ball moves to the side.

You can't do anything there.

I have a feeling this might go to the top bin.

Wasn't hard to guess.

He's at the backyard practicing skills. He starts with an ATW.

Okay, a Neymar touch.

And to the goal.

Yeah, a match clip. This are always interesting.

A free kick.

To the left top bin. A Pirlo-like performance.

A lot of free kicks for this video, but it's okay. These look cool.

There's that... that circle in the goal and the ball goes there.

More shots. These make me sweat.

Didn't go in. Sometimes it's like that.

I've got used to that. Sometimes it takes many attempts until you get it to the top bin.

The posts and the crossbar are the worst enemies.

Twice.

Three nutmegs.

At that point you can say you're practice is over for today. You can go home. See you next week.

This will probably be my last video on the subject of

Native vs Non-native language teachers

In the movie The Usual Suspects

Kevin Spacey's character at one point says:

The greatest trick the devil ever pulled was convincing the world he didn't exist

The greatest trick

I don't know who ever pulled

was convincing the world, native speakers are the best language teachers

How did we get to believe that native speakers are the best language teachers?

Yes, I said we, I used to hold that belief myself

used to, not anymore obviously

How did it come about?

it is not a trick, there is actually a very simple reason.

In the very distant past

foreigners visiting our country were the sole source of information about the outside world

culture, customs and of course language

And this went on for a long time until very recently I suppose

until literacy levels improved and and books were more readily available

But still, foreigners were the main source of language

Then the TV came along and there was much more information about

foreign cultures, customs and of course foreign languages

but native speakers were still important for all that

cool stuff you couldn't really see on TV couldn't ask the TV

And then, about 20 years ago the Internet came along

10 years later Apple company put the Internet in our pocket and

it changed everything

Foreigners visiting our country are no longer the only window to the outside world

we can now learn about culture, customs and other things on the internet

and of course, learn a foreign language

Now we have access to all kinds of reading materials as well as native speech

through movies, TV shows, podcasts

you name it

and of course dictionaries, free online dictionaries with pronunciation

Every question you might have about English grammar and vocabulary, customs and culture

has been answered a hundred times over on the internet, available for free.

I used to say:

Teaching is so much more than just being a human dictionary

Now I say:

Teaching is NOT about being a human dictionary

If all your teacher does is give you vocabulary and definitions

then he or she is not a teacher

that person is just a speaker.

So what is language teaching about, what is the language teacher supposed to do?

Taking into account the limitations you might have as a language learner

the teacher is supposed to give you a method of using all that free information

and study tools on the Internet

a systematic and logical approach to learning so you don't get lost, or waste time

Learning a foreign language is a very complex thing

plus, there is a jungle of information out there, it is so easy to get lost

therefore, you need a map, you need a system of learning

a sequential and logical approach to learning English, so you stay on course

The big question the 1 million dollar question is:

who is better suited to give you that approach, the best method of learning

Native or Non-native language teachers?

Suppose you had to move to a foreign country

a Japanese moving to Germany for instance

who would you go for advice on

finding a kindergarten for you son, or an international school for your daughter

or a nice Japanese restaurant or a supermarket selling Japanese food

which areas are safe and which to avoid

the cheapest way to send money to Japan and so on and so forth

Who would you ask for advice,

a Japanese expat who had already gone through all that and

successfully settled down in Germany or ask a local person, a native German?

If you wanted to start your own business

who would you go to for advice on how to go about doing it?

Steve Jobs or Tim Cook

Elon Musk or Akio Toyoda

If you wanted to change gender transition from male to female

who would you go to for advice?

Kris Jenner or Caitlyn Jenner

Evangeline Lilly or Lilly Wachowski

google them if you don't know who they are

If you wanted to learn how to dunk

who would you go to for advice?

Allen Iverson

or Shaquille O'Neal

If you wanted to break into show business

who would you go to for advice on how to

find a manager, market your music, book your first gig

Michael Jackson or Madonna

Michael entered show business at 6 years of age, Madonna at 20

Imagine you wanted to learn to compose music

You, not your child

if you wanted to learn to compose music who would you go to for advice

Let us finish with something crazier even more hypothetical

Batman or Superman?

How can Superman teach you how to fly for instance?

just hold your arms up above your head

Ridiculous right?

How can he teach you something he never learned

flying comes naturally to him he was born with it

Can he teach you how to shoot laser from your eyes?

enter Batman, one of us

He had to learn everything by himself,

he can also fly, not as fast as Superman, but still, fly

he can also shoot stuff

well not from his eyes but still with enough precision

you, as a member of homo sapiens

a thinking, rational person

who are you going to go to for advice on how to become a superhero?

Who is more likely to give you a tried-and-tested method

the most practical and realistic piece of advice

The one who was born a superhero, or the one who had to learn to become one

a very effective and efficient language speaker

Only a person who has mastered a foreign languag as an adult

can teach you how to learn one

I have mastered a foreign language, the English language as an adult

you know, that's my greatest inspiration.

It's what drives me to always keep on doing and searching, searching and searching.

Finding these women and these figures, all whats inside of me

is my attempt to be a reference to all of these black girls,

who otherwise mainly look up to what they see on TV, billboards, magazines.

The Roush R2300 Phase 2 Kit will be for the '11 to '14 5-liter truck owners out there

who are looking for massive power gains over a stock or naturally aspirated setup and would

when bolting up the Roush Phase 2 TVS Kit to your Coyote-powered truck.

Now, we've already got our baseline run out of the way using a 2012 5-liter truck.

We then installed the kit, reran the truck, and here are those results.

Baseline run using our 5-liter F-150 gave us 310 horsepower and 328 pound-feet of torque

at the rear wheels.

With the blower installed, the truck is now making 500 horsepower and 480 pound-feet of

torque at the rear wheels.

That's good for a peak gain of 190 horsepower over our baseline numbers and gain of as much

of 154 horsepower and 168 pound-feet of torque under the curve.

Now, obviously, there's gonna be a ton of factors at play here when talking about dyno

numbers, guys.

Tunes will be different, your bolt-ons might be a little different, and, ultimately, the

dyno and conditions will change your final numbers as well.

However, this is just to give you a better idea of what to expect when bolting up the

TVS kit to your own truck.

Let's break down this kit a little bit further, and without a doubt the star of the Roush

Phase 2 Kit is the Eaton TVS2300 rotor pack which is located in this housing here, and

it is gonna be the next generation or step up, if you will, from the older style M122

blower from Eaton, which was found on things like the old SBT Lightning, for instance.

Now, the TVS or Twin Vortices Series here is an extremely popular design that utilizes

twin four-rotor lobe packs that are twisted 160 total degrees, which just does create

a more efficient flow of the older style blowers and is basically just able to make more power

at lower boost levels.

Now, that rotor pack is then loaded into the rotor housing here which on the surface might

look pretty familiar, especially if you're kinda up to speed on these blowers, and that's

for a good reason.

Now, that's because Roush, Ford Performance, and even BMP often utilize a very similar

housing design, but with a big difference between the Roush and BMP option.

The Roush here is going to utilize a separate elbow, which is not pictured on the table

here.

It is a divided elbow.

Now, the BMP, on the other hand, is going to incorporate the elbow into the actual housing

here, which they claim is gonna be a little bit better from a flow perspective, and it

can be utilized with bigger aftermarket throttle bodies.

But, as you guys saw with our dyno numbers, the Roush design certainly has no problem

making power.

So what are gonna be some of your big benefits when choosing the Roush blower or a TVS blower

in general?

Well, in my opinion, there are a few biggies to talk about.

The first of which is going to be this instantaneous power along with a nice fat torque curve.

Now, the power delivery is going to be very linear and very predictable making them a

great choice for just about any type of driving style out there, and it is gonna be a little

bit different from those turbos or centrifugal superchargers which tend to suffer from a

little bit of lag.

Another nice thing about going with a TVS-style blower like this is the relatively simple

layout overall making for a slightly easier install at least in my humble opinion.

Now, the turbo, you have to alter the exhaust manifold along with intercooler piping, run

oil lines, change the exhaust along with just a host of other modifications.

Not really the case here with the Roush TVS blower.

You're simply gonna be replacing your intake manifold on top of the motor, meaning you're

really not gonna have to change the exhaust or plumb intercooler piping, things like that.

Now, sure, guys, of course, there is going to be some modification needed as I'll discuss

in a second, but far or less in installing or building a turbo kit.

But, as I pointed out earlier here, gang, this is certainly an all-inclusive turnkey

kit, and while I don't have everything on the table with me here, because there is a

lot included, I can run down some of the big things you can expect when opening the box

for the very first time.

Now, in addition to the TVS rotor pack here, you are gonna be receiving the lower unit

as well, which is actually your air-to-water intercooler portion of the blower.

Now, working to help cool the intercooler will be the included heat exchanger as well.

Just a heads-up here, guys, this thing does not include any external or additional fans,

but that is something you can add if you are interested.

Roush also includes their twin 60-millimeter throttle body and matching spacer with their

kit, which is fed by their 100-millimeter mass airflow tube and cold air intake system

along with the corresponding airbox.

Now, I'll be the first to admit, guys, the cold air intake certainly isn't the biggest

on the market, but the design is definitely on point and will deliver a nice smooth mass

airflow signal, which is something your tuner will appreciate if you do go the custom tuning

route.

And, with that said, this seems like a great time to mention the tuning options with this

kit, because, again, you do have some options here.

Now, this kit does include the Roush calibration, which is backed by their 3-year, 36,000-mile

warranty.

The calibration, however, would need to be flashed by your local Ford dealer using the

specific RDT Roush software.

Now, guys, again, I will be the first to tell you the Roush calibration is going to be a

little bit more conservative, and some people might argue correctly that you're gonna leave

some power on the table.

However, some people might value a conservative tune along with a corresponding warranty a

little bit more than extra horsepower.

On the other hand, you can certainly check out one of many different custom tuning options

out there, but keep in mind, guys, this will add to the final price, because you will have

to factor in the tune itself along with the necessary device, and you will not be able

to retain that Roush warranty if you do go this route.

Now, ultimately, again, there are a ton of options out there if you did wanna check out

some custom tuning.

For instance, I have a Roush TVS on my '14 GT at home.

I went with BMP for their tuning expertise, and I've had absolutely no complaints, but,

again, that is up to you guys at the end of the day.

Getting back to the Phase 2 Kit, we talked about the TVS rotor pack, we've talked a little

bit more about the intercooler setup here, your intake in the tune, but now let's talk

fueling.

The Phase 2 Kit doesn't include 47-pound injectors in addition to a unique set of high-flow fuel

rails.

Now, some tuners might try to recommend a larger injector along with checking out a

fuel pump booster, better known as a booster pump, but this does depend on your power goals

or if you go custom tune altogether, but, again, this is all just an added cost you

would have to factor in if you did wanna gun for bigger power.

Finally, gang, Roush does include a 75-millimeter pulley with the Phase 2 F-150 Kit, which depending

on your modifications will put you right between 9 or 10 pounds of boost with your particular

setup.

Now, a nice thing about the TVS blowers is that pulley swaps literally take a matter

of minutes, don't require any crazy tools or pullers.

Now, rounding out the kit, you're gonna find a number of different poses, all of your wiring,

new colder spark plug, brackets, and a new reservoir for your heat exchanger, and just

a number of other things to make this a 100% complete and turnkey option.

And if I can quickly just throw in my own two cents here, again, I have a Roush blower

on my 2014 GT at home, and just the level of ingenuity and thought that goes into this

kit really is apparent the moment you go to install it for the first time, and then once

it is installed, it just looks right at home in the engine bay, it does look like an OEM

part.

Let's switch gears and talk about the installation briefly, and as I pointed out at the very

top of this video, you're gonna be looking at a full three out of three wrenches on the

overall scale of difficulty, anywhere from a day at least to a weekend in the shop or

garage to get knocked out depending on your mechanical expertise.

And speaking of expertise, guys, this isn't necessarily something I'd recommend to my

first-time wrenchers out there as there are a lot of steps involved, and it can be a little

in-depth and tricky, so you might wanna take this one to your local speed shop instead.

On the other hand, if you plan on getting down and dirty with the Roush install, here's

a couple of big steps to expect.

Make sure you have a large set of tools on hand before getting started along with the

necessary installation instructions either printed out or pulled up on your laptop ready

to go.

Again, Roush does have a very detailed write-up that you can reference or print online.

Now, your first set of steps here basically, guys, is going to be disassembly.

This includes disassembling the front end of your truck slightly along with removing

that intake manifold.

Now, once your disassembly is complete, you will need to modify the front engine cover.

Now, this process can be a little different depending on your year, but, basically, the

idea is you're gonna need to grind off some material using a grinder or a cut-off wheel

in order to make room for the blower and the belt itself.

Now, something to keep in mind here also, guys, is that 2014 trucks will require a different

FIAD system, which is available on the product page.

Now, once that front engine cover has been modified, you can get to work installing the

actual supercharger along with some other steps as well.

This includes your fuel rail setup and the throttle body itself.

You're also gonna be tackling the vacuum lines at this point along with most of your electrical

connections.

At this point, you can move to the front of the truck and get ready to install the heat

exchanger along with all of the corresponding water lines.

Now, depending on the year of your truck, your front bumper cover might require a little

bit of trimming, but, again, just reference those detailed instructions.

With the heat exchanger installed and plumbed, it's time to move on to the belt assembly.

Now, there are a few different brackets and idler pulleys that will need to be installed

first before you can actually get to the belt itself.

Roush does include the belt routing diagram in the instructions to help you out along

the way.

With the belt in place, it's time to finish up the little stuff, like checking the rest

of your electrical connections, regapping the plugs if necessary according to the Roush

instructions, and then move on to the cooling system making sure it's filled and primed

before your first startup.

At this point, you'll need to figure out the tune situation as well.

If you have a custom tune, well, then just simply load that thing up, and you're good

to go.

However, if you are using the Roush calibration, go ahead and get it flashed by your local

dealer.

After all of this, start the truck up, check for any leaks, and your installation is complete.

Now, keep in mind here, guys, this is a very basic and very general walk-through of the

installation.

It is a lot of steps, so just make sure if you are gonna tackle this one on your own

you're prepared for a lengthy install.

Wrapping this one up here, guys, as a proud owner of the Roush blower myself, I can tell

you that the Phase 2 Kit is going to be an awesome way to totally transform your 5-liter-powered
