HOMES, WHERE THEY ARE BUYING TECHNOLOGY THAT HELPS THEM TURN

LIGHTS ON SOMETHING BY TALKING INSTEAD OF HAVING TO FLICK

ñ FLIP A SWITCH.

THAT COULD ACTUALLY HAVE AN IMPACT ON YOUR PRIVACY, AND

IF YOU EVER GET PROSECUTED FOR A CRIME, PROSECUTORS COULD

COME AFTER DATA THAT IS ELECTED BY THESE DEVICES.

CASE IN POINT: AN ARKANSAS MAN BY THE NAME OF JAMES BATES,

WHO IS BEING TRIED FOR MURDER.

NOW, APPARENTLY HE "FOUND" A MAN FORGING IN HIS BATHTUB,

CALLED THE POLICE AND TOLD THEM IT MUST HAVE BEEN AN

ACCIDENT AND HE MUST HAVE DROWNED.

BUT SCOOTERS ARE ACCUSING HIM OF MURDER, SAYING HE STRANGLED

THE MAN AND FOUND HIM IN THE BATHTUB.

WE DON'T KNOW WHAT THE REALITY IS, AND PROSECUTORS WANT

MORE EVIDENCE.

SO, SINCE THEY REALIZE THAT HE HAS THE ECHO SYSTEM, THAT

OF COURSE IS OWNED BY AMAZON, THEY CAN CONTACT AMAZON AND

GET THE DATA THAT THEY NEED.

THEY SPECIFICALLY WANTED RECORDINGS FROM HIS HOME.

THAT THEY GIVE YOU MORE DETAILS ON THAT.

PROSECUTORS USED BATES'S SMART HOME AGAINST HIM IN COURSE,

CITING INFORMATION FROM A SMART WATER METER TO ARGUE THAT

SOMEONE WAS USING A GARDEN HOSE TO CLEAR BLOOD OFF A PATIO.

THEY ALSO ATTENDED TO FORCE AMAZON TO HAND OVER INFORMATION

GATHERED FROM BATES'S ECHO SMART SPEAKER, ARGUING THAT IT

COULD HAVE MADE RECORDINGS THAT WOULD SHED LIGHT ON WHAT

HAPPENED THAT NIGHT.

INTERESTINGLY ENOUGH, AMAZON WAS CONTACTED BY THESE

PROSECUTORS TO SEPARATE TIMES, AND THEY SAID NO.

THEY SAID THAT THEY WILL GIVE HIS PURCHASE HISTORY, BUT NOT

THESE RECORDINGS, AND THEY CITED THE FIRST AMENDMENT AS A WAY OF

PROTECTING THEMSELVES AGAINST GIVING THIS INFORMATION TO

PROSECUTORS; HOWEVER, THE WAY THAT THIS ALL ENDED UP IS THAT

THE SUSPECT, OR AT LEAST THE DEFENDANT, DECIDED TO AT LEAST

GIVE THE PROSECUTORS ACCESS TO THESE RECORDERS SO THAT

AMAZON DIDN'T HAVE TO DEAL WITH THIS ANYMORE.

BUT I THINK IT WOULD BE INTERESTING TO SEE HOW IT

WOULD HAVE ASKED HOW HE WOULD HAVE PLAYED OUT IF AMAZON

CONTINUED TO RESIST AND THE DEFENDANTS CONTINUE TO

RESIST, BECAUSE THERE IS A PRIVACY SITUATION HERE.

GIANT PRIVACY SITUATION, I'M 100% ON AMAZON'S SITE HERE.

IF YOU ARE WONDERING, IS THE ECHO ALWAYS ON?

THERE IS A STORY ABOUT WIKILEAKS AND THE CIA IN TODAY'S NEWS

ONLY RECORDINGS MADE AFTER THE DEVICE HEARS ITS WAKE WORD,

SUCH AS ALEXA, OR ECHO, TURNS IT ON AND SENDS THE RECORDINGS.

THAT'S HOW IT IS SUPPOSED TO WORK, BUT THE REASON THE

PROSECUTORS WANT TO THE RECORDINGS ANYWAYS IS THAT OFTEN

TIMES ECHO CONFUSES SOMETHING THAT YOU SAID OR DIDN'T SAY, ANY

SOUND, FOR ALEXA OR ECHO OR COMPUTER, AND IT TURNS ON

AND STARTS TO SEND IT TO AMAZON.

OKAY?

IT'S ALWAYS ON ANYWAY, THE QUESTION IS, IS IT SENDING

IT TO AMAZON?

THE THIRD QUESTION WE GET FROM AN UNRELATED STORY IN THE NEWS

TODAY IS THAT WIKILEAKS REVEALS THAT THE CIA HAS BEEN LISTENING

IN ON US THROUGH OUR PHONES, OUR CARS AND OUR TVS, AND THEY

ARE USING THAT, WHETHER THE TV IS ON OR NOT ON.

IT'S BASICALLY A BUG IN ALL OF OUR HOMES IF YOU OWN A

SMART TV, AND THOSE OTHER DEVICES.

AND THEY FOUND A WAY, IN THE CASE OF THE PHONES, TO CAPTURE

THE TEXT MESSAGES OR THE VOICE RECORDINGS BEFORE THE COMPANIES

EVEN ENCRYPT THEM.

SO WE ARE ALL STARTED BY THIS TECHNOLOGY THAT IS

RECORDING AT ALL TIMES.

IN THIS PARTICULAR CASE, DO I WANT TO DEFEND THIS GUY?

THAT'S WHY I'M NOT A DEFENSE LAWYER, HIS EXCUSE SOUNDS

PREPOSTEROUS.

LIKE, MAYBE A GUY HAPPENED TO COME INTO MY HOUSE, SLIP

AND FALL INTO A BODY OF WATER IN MY BATHTUB.

YEAH, THAT HAPPENS ALL THE TIME.

I MEAN, DOESN'T SEEM LIKE A VERY CONVINCING DEFENSE IF YOU ASKED

ME, BUT I DON'T ñ IT'S NOT JUST ABOUT HIM, IT'S ABOUT ALL OF US.

I DON'T WANT THEM STEALING OUR PRIVACY, THAT'S ANOTHER

KIND OF CRIME, AND THEY ARE DOING IT ON A MASS SCALE.

LOOK AT THIS STORY, THE SMART WATER METER, THEY SAID IT'S

TO HELP YOU BUT IT'S MEASURING HOW MUCH WATER YOU USE IN

EVERY CASE, AND THEN THEY USE THAT AS WILDLY SPECULATIVE

EVIDENCE AGAINST YOU IN A COURT OF LAW.

THAT'S RIGHT, AND I THINK THAT THE BIGGEST PROBLEM HERE IS THAT

TECHNOLOGY CONTINUES TO ADVANCE, YET WE DON'T HAVE THE NECESSARY

COURT RULINGS PRECEDENTS, OR AT LEAST LAWS IN PLACE TO PROTECT

OUR PRIVACY AS THESE DIFFERENT TECHNOLOGIES GET DEVELOPED.

AND SO, I DON'T KNOW, DO I HAVE MUCH FAITH IN CONGRESS

TODAY WHEN IT COMES TO THIS ISSUE?

NOT REALLY.

AND SO, I WOULD HAVE LIKED TO SEE HOW THIS WOULD HAVE PLAYED

OUT IF THE COURTS HAD GOT INVOLVED AND HAD TO DECIDE THE

CONSTITUTIONALITY IF AMAZON HAD BEEN FORCED TO HAND OVER

THIS TYPE OF DATA.

YEAH, AND I VOTE NO.

AND IT'S PAINFUL IN MURDER CASES, I GET THAT, BUT THERE ARE

OTHER WAYS TO PREVENT OR PROVE ñ

THERE ARE OTHER WAYS TO SOLVE MURDER CASES.

WE USED TO BE ABLE TO SOLVE MURDER CASES WITHOUT WIRETAPS.

Private Cadence seemed not to hear the orders that Captain Smartypants had given her.

Of course, this wasn't unusual, Private Cadence was a great soldier, but for some reason I

had to translate all the orders the Captain gave her.

I barked "Did you not hear Captain Smartypants's orders?"

Cadence giggled.

I glared.

A private was not supposed to giggle at her superiors, I'd read that in the book I read

about military rankings.

And a general, which is what I was, was the highest rank ever.

A private was on the very bottom.

"No, General Twilight ma'am, I don't speak her language," Cadence replied.

I glared until she remembered to salute, which is what your supposed to do to a general.

She seemed confused by my glare for a few minutes until she remembered protocol and

saluted.

"She saaaaaid to guard the East End of the Fort!"

I ordered.

I was very good at ordering.

I was a general after all.

"Ma'am yes ma'am!"

Private Cadence replied with a silly grin on her face, and saluted again.

"And no smiling!

Captain Shining Armor will be attacking Fort Book any minute now and we must be prepared!

"Ma'am yes ma'am!"

Cadence said again, this time struggling to keep a straight face.

I don't know what she thought was so funny.

Fort Book was the most stunning Fort in all of Twilightopia, the glorious land we were

defending from the Evil Emperor Shining Armor.

Who was also my big brother, but that's not that important.

Fort Book was big.

It was at least one hundred feet tall and one hundred feet wide!

It was made to look like it was made of books, but it was actually made of rocks so that

evil invaders wouldn't get in.

It had another rock wall protecting it, and a moat, because moats are cool.

It was the most beautiful fort in the world, though right now it was raining so the fort

wasn't as comfortable as it was when it wasn't raining.

When it wasn't raining it was sunny and the sun made the rocks look like gemstones, they

sparkled so much.

Now...about my big brother.

He was the Captain of a huge army and he was gonna come and take Fort Book and soon all

of Twilightopia for himself!

He was evil and greedy and it was my job to defend Fort Book against his forces.

He was an army captain from the land of Armor which was right next to Twilightopia and was

always trying to take part of our country for itself, which is apparently what countries

who aren't friends, or allies as my books call them, try to do.

He does it a lot, which is why Fort Book has to be the best possible fort ever, so he and

his allies can't get in.

Captain Smartypants tapped me on the shoulder, snapping me out of thinking about my big brother.

"General, I think that might be them heading over the hills right now!" my quiet captain

told me.

"In fact, I think it is them, and they're heading right for us!

We have to be one hundred percent prepared!"

"Get your men to the West Wall to defend that side, I'm going to the East Wall!"

I ordered Smartypants.

She saluted and didn't laugh, which is why she is a captain, and Cadence is still a private.

"All soldiers to their battle stations!"

I ordered, which I am very good at of course, "We have the enemy upon us!!!"

Captain Smartypants saluted again as she took her position and began ordering her men around.

I went to where Private Cadence was standing and cleared my throat to get her attention.

"Captain Smartypants spotted Captain Armor, and we must be prepared!

Load the cannons!!"

I ordered her.

She obeyed, though I thought I saw a smile, which of course were not allowed.

"No smiling!"

I said.

Cadence saluted and forced herself into a straight face.

"Sometimes I don't know how you got out of boot camp with all that smiling you do!"

I said.

"Because I'm a good soldier anyway, ma'am," she replied.

Shining Armor came to our front gate.

I said and yelled "FIRE!!" to Cadence, who fired the cannonball at Shining's face, where

it missed and landed with a whump.

Another cannonball was fired, which hit members of his army in the face, and they slowly fell

to the barrage of attacks from the amazing Fort Book!!

"Keep firing, Cadence!

We have to hit Shining Armor!

He's the leader!!"

"Right away General!" she said.

Cadence fired our last cannonball, which hit Shining Armor right in the face.

"We won! we defended Fort Book!"

I said as my brother fell over.

"Oww, Twili!" my big brother, who wasn't really evil, he was really the best big brother in

the whole wide world, said.

"For a pillow, that hurt!"

I giggled.

The real Fort Book was really just kind of a pile of books with a sheet over it and pillows

surrounding it as a wall, but it was still the best Fort ever.

"Blame Cadence, she's the one that threw it!"

I said and collapsed into giggles.

"I guess I can smile now, huh?" said Cadence, the best foalsitter ever.

"I got you good there, Shining!"

Shining smiled that weird smile he always does around Cadence.

I don't know why he does it, I think it's one of those "almost grown up" things that

happens sometimes.

"Yeah, you did," he said, and smirked, then broke into hysterics like me, and then so

did Cadence, and even though it was a rainy yucky day in Canterlot, it was a super fun

day in our books.

Even Smartypants giggled a little, and she's normally pretty quiet.

NOW, APPARENTLY HE "FOUND" A MAN FORGING IN HIS BATHTUB,

CALLED THE POLICE AND TOLD THEM IT MUST HAVE BEEN AN

ACCIDENT AND HE MUST HAVE DROWNED.

BUT SCOOTERS ARE ACCUSING HIM OF MURDER, SAYING HE STRANGLED

THE MAN AND FOUND HIM IN THE BATHTUB.

WE DON'T KNOW WHAT THE REALITY IS, AND PROSECUTORS WANT

MORE EVIDENCE.

SO, SINCE THEY REALIZE THAT HE HAS THE ECHO SYSTEM, THAT

OF COURSE IS OWNED BY AMAZON, THEY CAN CONTACT AMAZON AND

GET THE DATA THAT THEY NEED.

THEY SPECIFICALLY WANTED RECORDINGS FROM HIS HOME.

THAT THEY GIVE YOU MORE DETAILS ON THAT.

PROSECUTORS USED BATES'S SMART HOME AGAINST HIM IN COURSE,

CITING INFORMATION FROM A SMART WATER METER TO ARGUE THAT

SOMEONE WAS USING A GARDEN HOSE TO CLEAR BLOOD OFF A PATIO.

THEY ALSO ATTENDED TO FORCE AMAZON TO HAND OVER INFORMATION

GATHERED FROM BATES'S ECHO SMART SPEAKER, ARGUING THAT IT

COULD HAVE MADE RECORDINGS THAT WOULD SHED LIGHT ON WHAT

HAPPENED THAT NIGHT.

INTERESTINGLY ENOUGH, AMAZON WAS CONTACTED BY THESE

PROSECUTORS TO SEPARATE TIMES, AND THEY SAID NO.

THEY SAID THAT THEY WILL GIVE HIS PURCHASE HISTORY, BUT NOT

THESE RECORDINGS, AND THEY CITED THE FIRST AMENDMENT AS A WAY OF

PROTECTING THEMSELVES AGAINST GIVING THIS INFORMATION TO

PROSECUTORS; HOWEVER, THE WAY THAT THIS ALL ENDED UP IS THAT

THE SUSPECT, OR AT LEAST THE DEFENDANT, DECIDED TO AT LEAST

GIVE THE PROSECUTORS ACCESS TO THESE RECORDERS SO THAT

AMAZON DIDN'T HAVE TO DEAL WITH THIS ANYMORE.

BUT I THINK IT WOULD BE INTERESTING TO SEE HOW IT

WOULD HAVE ASKED HOW HE WOULD HAVE PLAYED OUT IF AMAZON

CONTINUED TO RESIST AND THE DEFENDANTS CONTINUE TO

THE THIRD QUESTION WE GET FROM AN UNRELATED STORY IN THE NEWS

TODAY IS THAT WIKILEAKS REVEALS THAT THE CIA HAS BEEN LISTENING

IN ON US THROUGH OUR PHONES, OUR CARS AND OUR TVS, AND THEY

ARE USING THAT, WHETHER THE TV IS ON OR NOT ON.

IT'S BASICALLY A BUG IN ALL OF OUR HOMES IF YOU OWN A

SMART TV, AND THOSE OTHER DEVICES.

AND THEY FOUND A WAY, IN THE CASE OF THE PHONES, TO CAPTURE

THE TEXT MESSAGES OR THE VOICE RECORDINGS BEFORE THE COMPANIES

EVEN ENCRYPT THEM.

SO WE ARE ALL STARTED BY THIS TECHNOLOGY THAT IS

RECORDING AT ALL TIMES.

IN THIS PARTICULAR CASE, DO I WANT TO DEFEND THIS GUY?

THAT'S WHY I'M NOT A DEFENSE LAWYER, HIS EXCUSE SOUNDS

PREPOSTEROUS.

LIKE, MAYBE A GUY HAPPENED TO COME INTO MY HOUSE, SLIP

I'm J. C. I'm from Manila. That's the capital of the Philippines. I grew up there.

I moved to the U. S., specifically New York, in 2005 at the tender age of 21.

Moving to New York was an adventure. You know, I mean I was fortunate enough to get a scholarship

to go to grad school here. And I took that opportunity and it opened my eyes to a lot

of possibilities including exploring myself.

Earlier on when I just moved to the US I was so happy because you can be gay, you can be

yourself, and can do whatever you want. It was like the advent of, of the emergence of

social media and social connection - social networks. And people talk primarily through

chat rooms.

I was talking to this guy and we were talking probably like a good hour. We traded pictures

but usually we trade not face-first, you trade your body pictures. And then, I mean I looked

light-skinned in that picture for some reason and so he just assumed I was kind of white.

And then I said I was Asian. He said, "Oh. Sorry buddy. You know, you seem to be a cool

guy, but I'm not into Asians."

You know, of course, it affected my self confidence. I didn't know how to respond initially because

I am new. I grew up in a different culture. And I thought America's more welcoming to

people from other places.

Three years after that, still with a defeated, you know, self-ego, I was on my way to Fire

Island waiting for a friend of mine. We agreed that we're gonna meet up at the train station

- Jamaica. I was waiting for my train and then I saw him coming through the aisle. And

there were these two white guys in front of us. Again, at first, they were chuckling and

I didn't know what the reason was. I just ignored it. And then they kind of like started

pointing at my friend who was having difficulty walking through the aisle.

And then they started laughing because they said, "Look at that Asian guy going to Fire

Island."

And they chuckled. So I tried to ignore it because you know, I mean, you can interpret

that in many ways. And then one of them said that, "Who would fuck him?" So I kind

of like you know, tried to tap one of them and I said, "Hey guys, another Asian guy

behind you. Not that I'm eavesdropping but I think that was not funny."

But they were nice enough that they apologized and they said, you know, "We were just joking,

that was very insensitive of us."

And you know I took their apology and it gave me kind of like a - you know, that was the

first time I actually thought that, you know, if you stand up and then if you call out people,

you actually stop the behavior or at least you feel that you did something for yourself.

I've met a lot of friends who I consider are all like brothers and or sisters. And they're

like amazing friends. And even them, I have, like, multiple experiences where they would

make the same exact kind of, like, statements.

One good example is while we were in Uber going to a party after pregame, they're looking

through their Grindr and then they're like you know browsing through the boys. And then

they saw this one picture of a guy and then they're like, "He's cute... hot" you

know. And then one of them said "He looks Asian. Move."

And I said, "Guys, I'm right next to you. There's only three of us here on the backseat.

Now I mean, what do you mean by that? You know, I thought we were friends."

And they apologized, which is good because they're my friends.

But deep inside it does affect me. And it does affect how I see myself and how to communicate

with other people. It is important for me to speak up for myself and for others because

if I don't and they don't, nobody will. We live in a very diverse society and we have,

each of us has, a role to play and has something to give.

Private Cadence seemed not to hear the orders that Captain Smartypants had given her.

Of course, this wasn't unusual, Private Cadence was a great soldier, but for some reason I

had to translate all the orders the Captain gave her.

"Private!"

I barked "Did you not hear Captain Smartypants's orders?"

Cadence giggled.

I glared.

A private was not supposed to giggle at her superiors, I'd read that in the book I read

about military rankings.

And a general, which is what I was, was the highest rank ever.

A private was on the very bottom.

"No, General Twilight ma'am, I don't speak her language," Cadence replied.

I glared until she remembered to salute, which is what your supposed to do to a general.

She seemed confused by my glare for a few minutes until she remembered protocol and

saluted.

"She saaaaaid to guard the East End of the Fort!"

I ordered.

I was very good at ordering.

I was a general after all.

"Ma'am yes ma'am!"

Private Cadence replied with a silly grin on her face, and saluted again.

"And no smiling!

Captain Shining Armor will be attacking Fort Book any minute now and we must be prepared!

Army people don't smile!"

"Ma'am yes ma'am!"

Cadence said again, this time struggling to keep a straight face.

I don't know what she thought was so funny.

Fort Book was the most stunning Fort in all of Twilightopia, the glorious land we were

defending from the Evil Emperor Shining Armor.

Who was also my big brother, but that's not that important.

Fort Book was big.

It was at least one hundred feet tall and one hundred feet wide!

It was made to look like it was made of books, but it was actually made of rocks so that

evil invaders wouldn't get in.

It had another rock wall protecting it, and a moat, because moats are cool.

It was the most beautiful fort in the world, though right now it was raining so the fort

wasn't as comfortable as it was when it wasn't raining.

When it wasn't raining it was sunny and the sun made the rocks look like gemstones, they

sparkled so much.

Now...about my big brother.

He was the Captain of a huge army and he was gonna come and take Fort Book and soon all

of Twilightopia for himself!

He was evil and greedy and it was my job to defend Fort Book against his forces.

He was an army captain from the land of Armor which was right next to Twilightopia and was

always trying to take part of our country for itself, which is apparently what countries

who aren't friends, or allies as my books call them, try to do.

He does it a lot, which is why Fort Book has to be the best possible fort ever, so he and

his allies can't get in.

Captain Smartypants tapped me on the shoulder, snapping me out of thinking about my big brother.

"General, I think that might be them heading over the hills right now!" my quiet captain

told me.

"In fact, I think it is them, and they're heading right for us!

We have to be one hundred percent prepared!"

"Get your men to the West Wall to defend that side, I'm going to the East Wall!"

I ordered Smartypants.

She saluted and didn't laugh, which is why she is a captain, and Cadence is still a private.

"All soldiers to their battle stations!"

I ordered, which I am very good at of course, "We have the enemy upon us!!!"

Captain Smartypants saluted again as she took her position and began ordering her men around.

I went to where Private Cadence was standing and cleared my throat to get her attention.

"Captain Smartypants spotted Captain Armor, and we must be prepared!

Load the cannons!!"

I ordered her.

She obeyed, though I thought I saw a smile, which of course were not allowed.

"No smiling!"

I said.

Cadence saluted and forced herself into a straight face.

"Sometimes I don't know how you got out of boot camp with all that smiling you do!"

I said.

"Because I'm a good soldier anyway, ma'am," she replied.

"Then man your battle station and stop all the talking you silly nincompoop!"

Nincompoop was one of my favorite insults.

Shining Armor came to our front gate.

"I'm here General Twili!" he said, challenging me.

"Whatcha gonna do about it?"

"This!"

I said and yelled "FIRE!!" to Cadence, who fired the cannonball at Shining's face, where

it missed and landed with a whump.

Another cannonball was fired, which hit members of his army in the face, and they slowly fell

to the barrage of attacks from the amazing Fort Book!!

"Keep firing, Cadence!

We have to hit Shining Armor!

He's the leader!!"

"Right away General!" she said.

Cadence fired our last cannonball, which hit Shining Armor right in the face.

"We won! we defended Fort Book!"

I said as my brother fell over.

"Oww, Twili!" my big brother, who wasn't really evil, he was really the best big brother in

the whole wide world, said.

"For a pillow, that hurt!"

I giggled.

The real Fort Book was really just kind of a pile of books with a sheet over it and pillows

surrounding it as a wall, but it was still the best Fort ever.

"Blame Cadence, she's the one that threw it!"

I said and collapsed into giggles.

"I guess I can smile now, huh?" said Cadence, the best foalsitter ever.

"I got you good there, Shining!"

Shining smiled that weird smile he always does around Cadence.

I don't know why he does it, I think it's one of those "almost grown up" things that

happens sometimes.

"Yeah, you did," he said, and smirked, then broke into hysterics like me, and then so

did Cadence, and even though it was a rainy yucky day in Canterlot, it was a super fun

day in our books.

Even Smartypants giggled a little, and she's normally pretty quiet.
