DOJ Moves to CRUSH Cali's Sanctuary State Policies

Time's up for California and their brazen, lawless sanctuary state policies.

The DOJ is fighting back and will challenge the "constitutionality" of three of the

state's laws which protect criminal illegals.

From Breitbart

Attorney General Jeff Sessions will speak Wednesday about his Department of Justice's

(DOJ) first-of-its-kind lawsuit challenging the constitutionality of three of California's

"sanctuary" laws, Breitbart News has learned.

Relying on both federal statutes and the U.S. Constitution's Supremacy Clause, DOJ will

ask the U.S. District Court for the District of Eastern California to issue a preliminary

injunction blocking the enforcement of these laws intended to protect illegal aliens by

preventing cooperation with federal immigration enforcement.

DOJ will also seek declaratory judgement that these laws are unconstitutional – "preempted"

by federal immigration law – when it files late Tuesday night.

"The Department of Justice and the Trump administration are going to fight these unjust,

unfair, and unconstitutional policies that have been imposed on you," Attorney General

Sessions is expected to tell a gathering of California police officers Wednesday in Sacramento.

"We are fighting to make your jobs safer and to help you reduce crime in America.

And I believe that we are going to win."

A senior DOJ official made clear that he believed the laws intentionally created obstacles for

federal immigration enforcement in California, the state with most illegal aliens in the

country.

The defendants are the State of California, Gov. Jerry Brown, and California Attorney

General Xavier Becerra – the elected official who, perhaps more than any other, has made

protection of criminal illegal aliens and "resistance" to President Donald Trump's

immigration agenda his signature policy.

The doctrine of "preemption" dictates that, as federal law reigns supreme over state

law, states may not enforce laws that frustrate federal policies.

It has a long history, dating back nearly to the dawn of the Republic with 1819's

McCulloch v. Maryland.

In the immigration context, the doctrine was widely heralded by open borders advocates

in 2012, when the Supreme Court relied on it to strike down sections of Arizona's

tough SB 1070 anti-illegal immigration bill in Arizona v. United States.

The legal shoe is on the other foot now, as the Trump administration seeks to have California's

leading-edge sanctuary laws overturned on a similar theory.

All three laws, passed in response to Trump's victory in the 2016 presidential election,

added new dimensions to California's role as the nation's leading "sanctuary"

for illegal aliens.

Not content with being merely a typical sanctuary jurisdiction, where, as a matter of policy,

police do not contact U.S. Immigration and Customs Enforcement (ICE) agents about suspected

illegal aliens, collect information on an arrestee's immigration status, or comply

with requests to hold suspected illegal aliens for ICE pickup, California enacted HB 450,

SB 54, and HB 103.

HB 450 came into effect at the beginning of the year.

It prohibits private employers from cooperating with ICE.

Under the law, if employers do not refuse to allow ICE officials onto their property

without a warrant, they face stiff fines.

If they try to check an employee's immigration status a second time, they face fines.

If they do not inform employees of ICE enforcement efforts about which they know, they face fines.

During the first round of ICE raids after HB 450 went into effect, Becerra was very

clear that his office "will prosecute" employers who cooperate.

A senior DOJ official told reporters if the federal agency involved have been the FBI

rather than ICE, a law like AB 450 would be inconceivable.

He feared that, given its broadest reading, it might prohibit all private property owners

from assisting federal immigration enforcement.

In the case of HB 450, the California State Assembly's Judiciary Committee made clear

they were passing this law specifically because of "an expected increase in federal immigration

enforcement."

SB 54, also coming into effect January 1, affects law enforcement officials, holding

them statewide to the "sanctuary" standard previously in place in cities like San Francisco

under penalty of state law.

Under HB 54, California's police officers and sheriffs cannot provide ICE with the release

dates of the criminal illegal aliens whom they are holdings.

Except for those held for a narrow set of serious crimes, these law enforcement officers

cannot transfer detainees to federal custody voluntarily.

Finally, AB 103 is a 2017 law Becerra has used to "inspect" facilities the Department

of Homeland Security uses to house suspected illegal aliens who are awaiting removal proceedings.

DOJ believes these inspections have demanded access to proprietary DHS documents and information.

The government will first seek to have a preliminary injunction put in place to block enforcement

of all three laws while their constitutionality is considered.

DOJ will therefore have to show some irreparable harm that will come from allowing California

to use these laws in the meantime.

Senior DOJ officials were confident that, with a typical briefing schedule, they expect

a ruling on their preliminary injunction within weeks.

they've decided to keep watch your mother great advocate for women and

girls you have been the same way Chelsea and seeing this me to movement and

time's up what does this past year mean to you well it means to me looking at

the girls sitting in front of us that hopefully they're never gonna have to

have that moment yeah because hopefully in there

well it was a much different story when Ivanka Trump sat down with NBC News

during the winter olympics watch do you believe your father's accusers I think

it's a pretty inappropriate question to ask a daughter if she believes the

truth to it I don't think that's a question you would ask many other

well the last point that Chelsea made is absolutely correct if you work for the

president you work for the American taxpayer and you should be scrutinized

by the media I have no quarrel with that whatsoever but the rest of that set up I

do think that it's pretty glaring where to have the daughter of Bill Clinton who

is like the poster child of anti me to adult life and just to celebrate her as

a champion of women Hillary as a champion of women despite what she did

to ship some of bills accusers with no mention of that just airbrushed out lots

of happy applause obviously there's a double standard also not just Bill

Clinton we had just learned that Hillary Clinton and there on her campaign

shielded a sexual harasser and didn't fire him so I mean it's not just Bill

Clinton here and I think every American is just used to this story where

basically the Democrat gets a free pass and the Republican get sounded because

we now know the chain of events that led up to Hillary Clinton and her staff

talking about whether or not he should stay on staff as a habitual person who

had committed sexual harassment I mean there were discussions she definitely

knew about also Christa Gillibrand from the New York senator who has said that

Bill Clinton should have resigned well and this is someone who's trying to

stake her presidential ambitions on the me2 movement why doesn't someone ask

Josie Clinton about that so with the Harvey Weinstein part of it it is an

interesting component because at one point Chelsea Clinton was heading up the

Clinton Foundation so as a former person who had that job

I think it certainly is in the constellation of questions you could ask

about both our parents given the set of circumstances that we've seen over the

show's that they don't have a lot of faith in Chelsea Clinton to do anything

but catch softballs what about that what about that struggle though for Ivanka to

play both someone working inside of this White House and the president's daughter

I mean that there's a big difference in how she answers questions based on which

role she's playing at that moment right now and I think that that was a very

personal question and she blanched at it and I can't blame

her for reacting the way that she did I do think that tough questions of a

presidential adviser even it happens to be the president's daughter are fair

game but back to Chelsea she's written a book

called she persistent which is about women's empowerment and that was this

Ghazi ABC News interview that she was given with absolutely no attention paid

whatsoever to the baggage of her father and to Lisa's portraits of her own

mother we've seen the movie and now this is the

trailer but she's written she's written a book about this where it is she's out

there championing you know that you have to ask questions it's it's fair game

speaking of fair game to ask challenging questions given the premise of her whole

book but you know that the questioners I suppose you're focused on at the moment

but the moment is the me to movement moment so you take all of it into

account I would think that Chelsea Clinton would be really prepped for that

answer right I mean she's not I think she

probably knew she wasn't gonna get it to be honest she wanted she know appearance

or even without that she made a graham cracker

she missed an opportunity now they all brought it up or something yeah in some

way shape or form happen we've got more outnumbered in just a

This is Samirah.

She wants to hang out with her friend,

but she feels uncomfortable waiting at the bus stop

at this time of night by herself.

She takes her friend's advice and signs up for Bus Buddy.

She is given the option of using this app to either become a buddy or find buddies.

Here, a welcoming screen explains that if she feels unsafe at a bus stop,

she can use Bus Buddy to find someone to wait with her.

The following screens teach Samirah how to use the app and what each icon represents.

Now, she is prompted to input her starting location

and the bus stop she is heading to.

Then, the app searches for someone to wait with her

She found a Buddy!

Hi!

Samirah feels safe with this Buddy and is ready to head to the bus stop.

Samirah hears a sketchy noise and double clicks the alarm.

If she is in fact in an emergency, she can call 911 or alert her buddy.

The noise was nothing, so she goes back to the Buddy screen.

Samirah double checks the location she messaged her buddy to meet at.

Samirah isn't sure how close she is to her buddy, so she opens up the tracking feature.

She notices that she's very close.

Samirah meets up with her buddy.

Hi! Hi.

Are you Mindy?

Yeah. Hi. It's nice to meet you.

It's nice to meet you too. I'm Samirah.

Cool!

Um, how's your night going?

Okay. It's a little cold out. Ha.
