Strange things happen to law and justice in Poland
A student in Poland cursed President of Poland A. Duda on Facebook
Someone read the post and reported it to authorities
State prosecutors began investigating
The kid can spend up to 3 years in prison
for insulting President
That's what the law says in Poland
For the crime of insulting the president of Poland you can get 3 years in jail
(the insulting video: it was posted ' in reverse' making it look like the president is 'stealing' the wreath)
(PResident Duda Twit: A fellow reversed the film -
for some might be sunny - but not a big deal -
Prosecutors? Give me a break!)
Earlier a man from around Lublin in Poland
insulted the former president of Poland Komorowski
got a year in jail for calling the president a BS word
In another case a man in Poland got 3 years in jail for insulting the president on the net
as that's what the law in Poland says
Earlier this month In Uganda
a woman was jailed for falling president of Uganda
a pair of buttocks
he was charged with cyber harassment
In yet an9other case a man in Kazakhstan
made a huge error in judgement
and said a bad word about the president of Russia Putin
He calle Putin a terrorist and a fascist
who is destroying Russia -
got 3 years sentence
We have also seen a Canadian citizen
who was sent to jail in December
for insulting president Erdogan
a foreign citizen was sent to prison in Turkey
In March the court in Turkey found her guilty
her case is now being appealed by the Canadian consulate
Some time ago
there was a notorious case of a German comedian
who also insulted president Erdogan in a poem
There is some 2000 cases now opened in Turkey
for insulting Turkish president
German comedian wrote an insulting poem
the case became political quickly
German Chancellor Merkel
agreed with Erdogan that the poem was insulting in nature
a serious case in Germany
asin Germany you can go to jail for up to 5 years
for insulting the president
Here in the US
You can call the prudent all you want
as what you're saying
is protected by the constitution
which gives you the right to free speech
which allows you to tell it like it is
My take -
Indeed - I can say the president is dumb and badas*
and there is nothing the law can do about it
There are two main natural laws of every human being
the right to defend yourself
and the right to free speech
If a democracy lacks these
you don't have a country anymore
You got to have the right to speak your mind
Here in the US-
even hate speech is free speech
and is protected by the constitution
For example Madonna
who lately in a rally in Washington
said that the though many times
about blowing up the White House
Somehow no one knocked on her door to arrest her
Unless - there is a situation
that what you;re saying
causes a direct violence
and someone dies as a result
In other words
if there is someone who'd take Madonna's words
literally and attempted to blow up the White House or
or God forbid - did blow up the White House -
and said - he did it because of what she'd said
that could get Madonna in trouble with the law
Other than that - free speech - telling like it is -
are indispensable elements of American democracy
In Poland you have article 135 of the penal code
which it me is an archaic curiosity of prehistoric origin
and it should be changed asap
Poland;s highest court- Constitutional Tribunal
took up the issue in 2011
The Gdansk district court
asked Poland's Supreme Court for explanation
- -we wil throw a man to jail for 3 years - what are we doing here?
So they asked the Constitutional Tribunal for explanation
Does the man have a right to insult the president - yeas or no
Two Constitutional judges signed the decision
check it out on your own - 2011
and they said in their decision
Penalization for publicly insulting the president of Poland
doesn't interfere with free speech and the critique of the government
Really ?
If I know I can get 3 years in jail for telling like it is -
I stop telling like it is - that's obvious
Let's read more
Showing contempt by demeaning and insulting enunciations
or gestures
(...) do not serve the purpose of presenting opinions
and critique of public institutions
Therefore the offense can not be considered
as an acceptable form of critique of President of Poland
Gove me a break
They distinguish between opinion and its form
so opinion yes - cursing - not
In the words if I say - President is stupid
I go to jail -
But if I say - President is stupid because
this and that - he keep the silly law on the book
then I'm fine
But if I see the president passing by
And I yell out- Mr President - article 135 - F** you!
Mr Kolonko comere for a sec
You have insulted the prudent of Poland
- but he was just passing by -I flipped him a finger -
No you can't do that
Showing contempt by demeaning statements
or gestures - Mr Kolonko -
it doesn't serve the purpose of presenting opinions
therefore the insult cannot be considered acceptable critique
you're going to jail for 3 years - have a nice day
If you have a law like that which still functions
Like I said to you before -
Law defines the state
State defines nation
the nation defines the country.
Trash article 135
The constitution should be changed
I'm Max Kolonko - and I still tell it like it is - from New York
