Youtube daily report Aug 12 2018

In this video I am going to show you what happens when you ask for opinions about your

photography and I'll explain what you should be doing instead.

Stay tuned.

Hey gang!

Stop asking people what they think about your photographs or what they think you should

do to improve - just stop.

It's not helping you - in fact it's making it harder to progress and improve as a photographer

because frequently the opinions that you get influence your future decisions and make you

doubt your own creative instincts.

I recently did a little social experiment with two glamour headshots from a test shoot

that I did with a beautiful young model.

Stay tuned till the end and I'll share the behind the scenes of how I created theses

shots.

This was an experiment designed to get good engagement - in other words - lots of comments

and lots of opinions.

I have a very clear favorite between the two and I'll only use one of them in my portfolio.

I'll tell you which one in a minute.

I posted both of these images in 32 different Facebook photography groups that are dedicated

to topics like portraiture, fashion, mirrorless cameras, micro 4/3 format and Olympus.

I also posted them to my Facebook business page, my personal page and in my own TOGCHAT

LIVE Facebook group.

Along with the images I shared this behind the scenes shot to add some value by teaching

people how I did the shots - and I asked this simple question…

Which do you prefer - and WHY?

So what happened?

I got a great response - over 1,100 comments were posted.

There were about 15 comments that didn't make a selection but made it a point to tell

me how much they hated the photographs.

There were another seventy or so comments where people didn't express their preference

but told me things like if I took the hair from one shot and put it in the other - then

they would like the photo.

The remaining comments split just about 50/50.

The people who like the first shot commented consistently that they loved the model looking

directly into the camera and the almost startled expression.

Many people mentioned liking symmetry in a photograph.

This group often complained about the second shot saying that the messy hair on the models

arm was too distracting.

One person explained that the messy hair made him want to itch!

Overwhelmingly people complimented the beautiful model.

The other half who picked the second shot loved the leading lines and the models expression.

This group frequently complained that the model looked stiff and lifeless in the first

photo. and the list goes on.

So the result: the post was very successful at engagement and even some new followers.

But as far as learning anything about my photography - what did it teach me?

Nothing.

It was basically a 50/50 split with comments that made it clear that different people have

different tastes and opinions and there is no way to satisfy everyone.

Kind of like politics.

And there lies the problem with opinions….

The people who gave me their opinion didn't have the same experience with the subject

as I did and they don't have the same emotional attachment to the shot as I do.

Think about it - did you pick up a camera for the first time because you wanted to impress

someone?

Or because you wanted to create and record the moments of your life?

Science has taught us that knowing the opinions of others will impact our decision making

process and often times not for the better.

Opinions hold great influence especially when they come from someone who we respect.

Unfortunately opinions usually lack context - an understanding of the circumstances and

choices and opinions rarely offer solutions - they are just a shallow snap judgements.

History has also shown us that the most creative among us are the ones that are brave enough

to ignore opinions and the judgement of others and follow their own inspiration - wherever

it may lead them.

GREAT Photography is not about being right or wrong.

My favorite shot BTW - #1.

I'm proud of both shots - but the first one is what I had in my mind when I set up the

fans and I love the eyes staring right back down the barrel of my lens - and yes - I am

a big fan of symmetry.

I did a similar social media post with these two photos.

People overwhelmingly picked this first shot and just like the other photos offered plenty

of ways that I should have done them differently.

My favorite…

The second shot.

I love the chaos of the red balls and the calmeness of the model in the center.

Even though people overwhelmingly picked the first one - this is the shot that I will use.

Don't ask for opinions and learn to take them with a grain of salt.

If you want to have success as a photographer you have to learn to live and die by your

decisions and you have to learn that NO other person will have the same experience with

your photographs as YOU do - and that is ok.

BTW - success as a photographer simply means achieving your goals.

Those goals may be just having the ability to produce great family photos or they could

involve being able to pay your bills with a camera and work as a full-time photographer.

The bottom line - it's about doing what makes YOU happy.

Photography that YOU are passionate about in the way that you like to view it.

If you are thinking about turning pro and want to build a following or get more customers

- you have to shoot what you shoot - the way you like to shoot it and do it to the best

of your ability and then find the people who like what you do and who are willing to pay

for it.

Not every one will.

I promise you there are a lot of people who think my photography sucks.

And that's ok!

Both of these shots are simple one light portraits.

I have my model placed about 3 feet in front of a Savage Universal Thunder Gray Seamless

paper backdrop and I am using one Interfit Honey Badger with a 28" Studio Essentials

Beauty Dish with the sock in place.

In case you are wondering - a sock is a cloth diffuser with elastic sewn in the edges that

you can stretch over the face of a beauty dish to soften the light.

I have a white foam core reflector underneath the model for a bit of fill and to add to

the catchlights in her eyes.

The vertical white reflectors that you can see in the background - are really not impacting

this photo at all.

They were left over from a previous shot I did and I just moved them out of the way to

do the blowing hair.

One fan is placed on the floor behind my subject and it's aimed straight up which blows her

hair up and forward.

The second fan is in front of the model to help blow the hair of off of her face.

I always have my makeup artist or an assistant along side the model to help manage the hair

while I'm shooting.

Here is a third version that I also liked - but not as much as the first two.

New USCIS NTA Policy Ambush On Permanent Residence And Citizenship (Immigration Tips & Tidbits) - Duration: 23:03.

If you recall a few days ago, I discussed the NTAs

in terms of going to the immigration court in a recent Supreme Court decision.

In this discussion, I'd like to share with you some recent USCIS memos

which have the potential to harm thousands of immigrants

and their families

when they're applying for permanent residence benefits

or even when they're seeking citizenship

after being a permanent resident for so many years.

In these two memos, USCIS has been converted,

in essence, by the Trump Administration

from a service benefit agency to a law enforcement agency.

Sort of like ICE, sort of like sort Customs and Border Patrol.

They have always been primarily seen as law enforcement agencies,

and their job typically includes serving individuals

that they believe are removable and deportable with Notice to Appears.

Well, that function, it's always been part of the USCIS guidelines.

It has never been really part of their mission

because their mission has been more to review applications

find out if someone really qualifies

and not so much in terms of sending someone to immigration court

to be deported unless they suspected something like fraud

or they found some major crime had been committed

or that it was a national security issue that this person

was involved with.

Other than that, USCIS has pretty much taken a softer approach.

But these memos change that.

These memos changed the role of USCIS in a lot of ways

to one of law enforcement,

and I don't believe this is new.

If you've been watching the Trump Administration over the past 18 months,

you know that they're just getting tougher and stricter

and harsher on immigration issues and towards immigrants.

I believe the image that we saw of Chris Kobach,

who is running for Kansas governor,

at the beginning of the Trump Administration,

where they found him with a memo that was titled immigration

and they had some issues lined up on it.

I believe this has been part of a master plan.

Maybe it's been modified a little throughout the succeeding months.

Maybe not.

But there's always been a plan to start tackling

immigration issues and to tightening the noose around

immigrants slowly but surely over the past 18 months.

If you've been involved in any way with filing a green card application

or filing a permanent, a, a citizenship application,

you'll notice that the applications have gotten longer, way longer.

What there is now is there are a lot more red flag issues

and all that I believe is part of the plan

to move USCIS from a service-based industry

into one that's also part of the law enforcement mechanism.

So let's start with that.

In terms of Notices to Appear, what is a Notice to Appear?

Well, basically a Notice to Appear is a charging document.

It begins the immigration court proceedings.

It says that we want to try to deport you.

And we have plans to deport you.

And because of that, once you receive that,

you're no longer eligible to seek benefits through USCIS.

You're now under the jurisdiction of the immigration court.

So there's basically two major memos that have been released over the past 60 days.

The first one is the June 28, 2018 USCIS memo,

which for simplicity sake I'm going to call the "NTA guidance" memo.

In that memo, they focus in on what types of activities

are priority enforcement for the issuance of NTAs by USCIS officers.

They listed various ones.

I'm not going to go through all of them because

that will really take quite some time,

but I'm going to briefly cover some grounds here.

First, they said anyone has been convicted of any criminal offense.

That is a little frightening.

Any criminal offense.

Imagine that.

I mean it could be something as minor as a shoplifting offense perhaps,

and they're still going to say, wait a minute,

you could be removed for that.

We're going to issue an NTA

for you to go to immigration court,

so that you have to answer to ICE

and you have to answer to the immigration judge

and see if you're worthy of not being deported.

There's also, they also mentioned charges,

if someone's been charged with a criminal offense

that hasn't been resolved.

For instance, I had a woman call me a few months ago

that went to her adjustment of status interview with her

United States citizen husband.

At that interview,

she was told that she hadn't totally

revealed everything on her application,

that she did not reveal an outstanding warrant

which she didn't, she claimed, she didn't know anything about.

But in any event, she was taken into custody right then and there.

Now, her husband, very smartly, quickly bailed her out

so that ICE wouldn't have time to place her,

to take her into custody and place her in a detention center.

So he bailed her out real quickly.

The issue went back to like a 2005

driving violation

and she still owed some money.

He quickly paid that off.

They went, they had a lawyer go, a criminal defense lawyer

go with them to court, they pulled the warrant.

They paid the fine and now they're out of the red zone in terms of that offense.

But that's exactly what's going to happen

to a lot of individuals who are not careful.

Something that may have happened years ago

could lead to bigger problems.

The memo also mentioned acts that

constitute chargeable criminal offenses.

Which means it hasn't been charged yet.

So what's an chargeable criminal offense?

I mean something, so an immigrant,

especially if they're not prepared well

or they go alone.

Maybe an uncle, an aunt, or a notario fixed their papers.

They have not been told what to expect

and they're questioned at the interview

and the officer starts asking some things,

and they say something about an act,

then the officer starts probing it.

And in the officer's interpretation,

that act could be a chargeable criminal offense.

Wow. That's amazing.

That could lead to denial.

That could lead to a Notice to Appear

in immigration court to face deportation charges.

Now, of course, the memo mentioned items, you know,

like fraud or willful misrepresentation.

But one that goes back, way back,

mentioned in the memo was abuse of public benefits.

Where this is likely to occur

is an undocumented female immigrant has a child.

The child is born here.

So the child is going to be, is a U.S. citizen.

They're entitled to some public benefits.

But in the explanation of the benefits,

maybe how the money was spent.

I don't know how officers are going get it to say it an abuse.

But they have something that they abused the public benefits.

And that's going to lead to problems

and an NTA and going to immigration court.

This one, people are going to have to be really careful with this one

because this is not uncommon scenario.

I really think, as I was reading this memo,

that more than ever,

immigrants are going to have to talk to lawyers.

They're not going be able to just go to notarios

and immigration assistants and

paralegals and their uncles and cousins.

These are some tough issues.

Another one that's mentioned in a memo is

a good moral character for naturalization applicants.

Imagine that.

You're applying for naturalization, and they say,

"Wait a minute, you did something that was a bad moral act years ago,

and so we think that should have precluded you perhaps

even from becoming a permanent resident."

An individual, I received a call from an individual,

who had been denied naturalization

and had received a Notice to Appear

which leads me to believe, just like the instance

from the woman that was actually referred to law enforcement at her interview,

leads me to believe that although this memo came out on June 28,

that the government has already been implementing these policies

at various offices throughout the country.

Which ones I'm not really sure.

But I do not believe this memo is just doing it now.

I think they're doing it even without, even before the memo.

So this individual said that

he had been denied citizenship, and I said, "Why?"

He said, "I committed fraud."

"Oh, what fraud?"

"They said that I didn't admit to smuggling in 1972."

And I said, "1972? Did you smuggle someone?

"No sir."

I said, "Well, then what happened?

He goes, "When I was coming across the border,

and I had my wife with me in the car."

And I said, "Okay, so what was your status?"

"I was a lawful permanent resident."

"Well, what was your wife's status?"

"She was a lawful permanent."

"Was there anyone else in the car with you?"

"My father-in-law."

"And what was his status?"

"He was a U.S. citizen."

"At the time?"

"Yes, there were only the three of you in the car?"

"Yes."

"And all three of you were legalized?"

"Yes."

"Where's the smuggling come in?"

"Well, as we were crossing, and they asked us for our documents,

my wife inadvertently said that she was a U.S. citizen

which she quickly corrected and said U.S. lawful permanent resident,

but we were sent to secondary and we spent about an hour there

and went through questioning and

that's all I can think of in 1972.

They wrote us up and it shows up as smuggling."

"And they denied your application because of that?"

"Yes."

"And so now you have to go to immigration court

to face the deportation charges."

Now, that case very well

could possibly fall under the issue we were discussing a few days ago

because I'm not sure that when USCIS issued him the Notice to Appear,

that it had the time and place.

And in fact, right now, the two memos that I'm discussing here,

actually,

they are on hold because the government needs more time to write

the implementing regulations for the offices to follow.

And because of that, I'm assuming that may be related to the recent Supreme Court case,

that they have to issue a date and time on the Notice to Appear.

Now, that's going to be a problem for them.

How are they going to get the date and time,

on the day of the interview?

Are they going to create a special hotline

with immigration courts where an immigration officer tells

the person at their interview, "Well, hold for a minute.

I've got to go to talk to my supervisor."

And then the supervisor gets on this hotline to immigration court

and they get a date and time.

They get it all set up, and then they come back ten minutes later.

Boom! They slap the Notice to Appear on the individual.

Is that where they're headed?

I'm not so sure, but that could very well be what they are talking about.

Now, there was a second memo

which follows shortly afterwards.

It's July 13, 2018.

For simplicity's sake I'm calling that

the RFE (Request For Evidence)

and Notice of Intent To Deny memo

because those were the two main issues

that were discussed there.

Now, how the two issues, how the two memos, connect,

there's still some speculation on that.

But I think common sense shows that

the second memo clarifies and tightens

the noose created by the first memo.

Let me discuss that. Okay.

The notice, the request for evidence, the way it's worked

when an individual goes to immigration court,

I mean goes to an immigration interview,

and the officer is going to deny it,

well normally the way it's worked is that the officer would send a letter

to the individual or give them a notice that they have

30 days in which, if they feel the decision is wrong,

to file a motion to reconsider or a motion to reopen.

And in addition, the person, if there was something small

that they could have corrected, that they really made a mistake,

they could also reapply again.

Now, the two new USCIS memos do nothing to change that.

USCIS, as I said, has always had the power to issue Notices to Appear.

They just didn't execute it because they were more a service-based agency

and they would hold back on that and give people

time to decide what they were going to do

before they would notify them of having to go to immigration court.

Now, however, it's going to be more instant,

and there are numerous situations where this could be occurring.

For instance, if someone applies,

let's say, someone applies for adjustment of status for a green card

through marriage to a U.S. citizen

and the U.S. citizen doesn't submit

a certified copy of a divorce to a former spouse.

Well, now instead of a request for evidence,

that can be the basis of a denial outright

because that's something that should be in the initial package

and should be given to them and

without that, you know, USCIS officers may be

instructed now to interpret that as a sign

that they don't have it,

that this is an indicia of immigration fraud.

How about an individual who submits financial documents

and they don't quite meet the level of support

for their spouse that they should have,

or they forget to submit

the proper tax returns or recent check stubs or something.

That could be a basis of a denial.

Or maybe a death certificate of a former spouse,

or maybe even a marriage certificate

or the birth certificate is not translated from another country.

Is that now going to be the basis for issuing

a Notice to Appear in immigration court?

It very well could, given the emphasis of this administration.

In the old days, the policy was,

if there if there is no possibility

of the individual to correct this error,

then they issued a Notice to Appear.

Now, that's been totally stripped,

so it's not whether there's no possibility.

It's whether, is there an error, is there a mistake,

is there a ground so we can get them to immigration court?

And what this does is it cuts in the individual's right to defend themselves.

Imagine an immigrant spouse, who,

someone comes in on a tourist visa,

then they fall in love and they file papers.

But now when they get sent to immigration court,

they're going to be, that time could may be counted as unlawful presence

and because, look, immigration courts are already,

already overburdened. Okay.

We know that at least 700 thousand cases

are backlogged in immigration court.

So add how many more, a hundred thousand maybe,

maybe more? All of a sudden you add that to the immigration court,

so now someone is going to be facing

and they can't leave without incurring a five-year bar

and if they stay here they might go from a three-year bar of unlawful presence to a

ten-year bar - because now they've been here instead of 180 days,

three-year bar, they move over to 365 days.

That could be what happens to them,

and that's a real, real, real issue that immigrants have to be worried about.

Imagine, too, that the 601A waivers,

when someone applies to show hardship

to a qualifying relative, to a spouse, so that they can go to the interview abroad,

and they're denied that.

Well, in the past, that hasn't led to a Notice to Appear.

That hasn't led to being forced to go to immigration court.

Well, now it very well may.

And how about a basic immigrant petition, an I-130?

A child over 21 who is a citizen files for a mother,

and there's something wrong in that application,

and it's denied.

Well, they know now, right,

that the mother is here without papers?

Is that going to lead to her being sent to immigration court

as an undocumented immigrant?

I was at a recent naturalization interview

and the officer was questioning my client

about a previous citizenship application she had submitted

that was denied several years before,

and it was denied and they went to her house

and they inspected her. She was still at the time living with her husband.

They were living in separate rooms.

They had mentally checked out.

But they were a couple and maybe they were going to get back together.

But it was well after she had cleared the conditions on her green card,

as well as after she had been a permanent resident four or five years.

She didn't need her husband in order to apply

for citizenship at that time.

Whoever helped her marked the wrong boxes. She was denied.

So we're at this interview

and they're questioning her on that.

My simple question "Why are you questioning her on the old fraud,

if you think it's a fraud?"

And they said, "Well, he wasn't denied as a fraud."

And I said, "I know that because I've seen her records.

What was it denied on? It was denied on a suspicion of something, correct?"

I said, "But look at the dates."

I said, "Is there anything that when she came in on a fiancé visa,

was she denied?

No.

Was it based on when she got her conditional green card?

No.

Was it based on when she was given her green card?

No.

It was at a citizenship interviews years later

because they said that she wasn't with her husband.

Yet she had already exceeded five years as a permanent resident.

She didn't need that. It was misfiled and your records are wrong."

Now, if I had not been there?

She would probably have received an NTA.

That's the danger of what's going on with these memos.

They're going to be placing so many individuals in immigration court.

Look, here's my view.

You're going to need a lawyer

even for the simplest of filings.

You can't take the chance of someone

not filling out your papers correctly,

not knowing what's required,

and for a lot of clients,

for a lot of immigrants, you got to slow down.

Sometimes it takes a while to put that package together

completely in an orderly manner.

You've got to give your attorneys and the paralegals time.

You've got to give them time to do it correctly,

especially now, because that quick ride,

that quick motorcycle ride to a green card

that you're hoping for

may be a slow boat to immigration hell.

You don't want that and so with that,

I am going to close this discussion.

And I really want to encourage you to keep an eye on these policy memos.

The policy memos are not in full effect yet.

They may very well go into full effect any day.

Hopefully, they never go into effect.

But in any event, immigration can still,

or USCIS can still, implement a lot of these policies

because it is in the scope of their authority.

I really hope you're super careful.

Don't procrastinate seeing someone that can help you.

Don't delay.

Don't omit stuff.

Tell the truth to whoever helps you.

And be very, very careful.

Whether my friend did fly on our 2nd day of Meghalaya trip.

We woke up to heavy rains in Dawki

We spent our first night in Lamin Guest House

Basic, Neat and Clean and right in the middle of Dawki town

So without wasting any time, we started on our drive at around 8am

So this is the road to Dawki.

The Umngot river on one side and Bangladesh across.

It was raining heavily when we reached Dawki Boating point.

Because of strong winds and heavy rains we had to skip boating

But instead we saw something very interesting.

How do the locals drag their boats out of the river when season ends.

So this is how boats are dragged up the hills

Isn't it something new?

And watch this. Natural fridge made from chilled rain water.

As soon as rain stopped, first we recharged ourselves with two hot cups of tea

and then set out on our onward drive.

After Dawki Boating point, our next stop was Dawki waterfall.

And we really had no idea on what to expect there.

So I'll leave it to you, to judge how it felt being there.

After leaving Dawki Waterfall

and driving on the Riwai Dawki road for about 1km,

we reached another waterfall.

The specialty of Riwai Dawki Road is that

It runs parallel to the India Bangladesh border

Where on one side you get to see the Indian hills

and on the other side vast plains of Bangladesh.

So let's explore our 2nd waterfall.

So ladies and gentleman, this is the Borhill waterfall

where water looked like milk.

straight to Bangladesh on the other side.

Our next target was Riwai village.

The weather was clear and sunny when we left Borhill falls.

We crossed a lot of small villages on the way where we saw a lot of children playing.

But as we moved ahead, the weather deteriorated.

And it started to darken because of the fog.

We reached Riwai by around 4pm.

About 2km from Riwai, lies Mawlynnong, Asia's cleanest village.

But uncle Goolge shows it somewhere else. A lot further.

And one more important thing.

There's a very special thing in Riwai, which should not be missed.

the Living Root Bridge.

But uncle Google shows this in Mawlynnong village (someone correct it please...)

So let's go for a walking tour of Riwai village.

As time was scarce, we had to skip Mawlynnong this time.

But Riwai also gave us the impression of a very clean and model village.

where we saw a lot of strategically placed bins

and garbage was confined to the bins without a single litter any where.

We walked through Riwai village towards the Living Root Bridge.

To reach you've to climb a flight of about 100/150 stairs.

And when we reached there...

we saw the day's BEST view.

So how was the Living Root bridge?

By the time we left Riwai, it was already dark.

And our next plan was to drive to Shillong via Laitlyngkot.

But as usual, plan changed and we reached Cherrapunjee/Sohra instead.

at around 10pm.

We were so lucky to get a hotel for the night without any pre booking.

and finally I shut down my camera for the day.

New USCIS NTA Policy Ambush On Permanent Residence And Citizenship (Immigration Tips & Tidbits) - Duration: 23:03.

If you recall a few days ago, I discussed the NTAs

in terms of going to the immigration court in a recent Supreme Court decision.

In this discussion, I'd like to share with you some recent USCIS memos

which have the potential to harm thousands of immigrants

and their families

when they're applying for permanent residence benefits

or even when they're seeking citizenship

after being a permanent resident for so many years.

In these two memos, USCIS has been converted,

in essence, by the Trump Administration

from a service benefit agency to a law enforcement agency.

Sort of like ICE, sort of like sort Customs and Border Patrol.

They have always been primarily seen as law enforcement agencies,

and their job typically includes serving individuals

that they believe are removable and deportable with Notice to Appears.

Well, that function, it's always been part of the USCIS guidelines.

It has never been really part of their mission

because their mission has been more to review applications

find out if someone really qualifies

and not so much in terms of sending someone to immigration court

to be deported unless they suspected something like fraud

or they found some major crime had been committed

or that it was a national security issue that this person

was involved with.

Other than that, USCIS has pretty much taken a softer approach.

But these memos change that.

These memos changed the role of USCIS in a lot of ways

to one of law enforcement,

and I don't believe this is new.

If you've been watching the Trump Administration over the past 18 months,

you know that they're just getting tougher and stricter

and harsher on immigration issues and towards immigrants.

I believe the image that we saw of Chris Kobach,

who is running for Kansas governor,

at the beginning of the Trump Administration,

where they found him with a memo that was titled immigration

and they had some issues lined up on it.

I believe this has been part of a master plan.

Maybe it's been modified a little throughout the succeeding months.

Maybe not.

But there's always been a plan to start tackling

immigration issues and to tightening the noose around

immigrants slowly but surely over the past 18 months.

If you've been involved in any way with filing a green card application

or filing a permanent, a, a citizenship application,

you'll notice that the applications have gotten longer, way longer.

What there is now is there are a lot more red flag issues

and all that I believe is part of the plan

to move USCIS from a service-based industry

into one that's also part of the law enforcement mechanism.

So let's start with that.

In terms of Notices to Appear, what is a Notice to Appear?

Well, basically a Notice to Appear is a charging document.

It begins the immigration court proceedings.

It says that we want to try to deport you.

And we have plans to deport you.

And because of that, once you receive that,

you're no longer eligible to seek benefits through USCIS.

You're now under the jurisdiction of the immigration court.

So there's basically two major memos that have been released over the past 60 days.

The first one is the June 28, 2018 USCIS memo,

which for simplicity sake I'm going to call the "NTA guidance" memo.

In that memo, they focus in on what types of activities

are priority enforcement for the issuance of NTAs by USCIS officers.

They listed various ones.

I'm not going to go through all of them because

that will really take quite some time,

but I'm going to briefly cover some grounds here.

First, they said anyone has been convicted of any criminal offense.

That is a little frightening.

Any criminal offense.

Imagine that.

I mean it could be something as minor as a shoplifting offense perhaps,

and they're still going to say, wait a minute,

you could be removed for that.

We're going to issue an NTA

for you to go to immigration court,

so that you have to answer to ICE

and you have to answer to the immigration judge

and see if you're worthy of not being deported.

There's also, they also mentioned charges,

if someone's been charged with a criminal offense

that hasn't been resolved.

For instance, I had a woman call me a few months ago

that went to her adjustment of status interview with her

United States citizen husband.

At that interview,

she was told that she hadn't totally

revealed everything on her application,

that she did not reveal an outstanding warrant

which she didn't, she claimed, she didn't know anything about.

But in any event, she was taken into custody right then and there.

Now, her husband, very smartly, quickly bailed her out

so that ICE wouldn't have time to place her,

to take her into custody and place her in a detention center.

So he bailed her out real quickly.

The issue went back to like a 2005

driving violation

and she still owed some money.

He quickly paid that off.

They went, they had a lawyer go, a criminal defense lawyer

go with them to court, they pulled the warrant.

They paid the fine and now they're out of the red zone in terms of that offense.

But that's exactly what's going to happen

to a lot of individuals who are not careful.

Something that may have happened years ago

could lead to bigger problems.

The memo also mentioned acts that

constitute chargeable criminal offenses.

Which means it hasn't been charged yet.

So what's an chargeable criminal offense?

I mean something, so an immigrant,

especially if they're not prepared well

or they go alone.

Maybe an uncle, an aunt, or a notario fixed their papers.

They have not been told what to expect

and they're questioned at the interview

and the officer starts asking some things,

and they say something about an act,

then the officer starts probing it.

And in the officer's interpretation,

that act could be a chargeable criminal offense.

Wow. That's amazing.

That could lead to denial.

That could lead to a Notice to Appear

in immigration court to face deportation charges.

Now, of course, the memo mentioned items, you know,

like fraud or willful misrepresentation.

But one that goes back, way back,

mentioned in the memo was abuse of public benefits.

Where this is likely to occur

is an undocumented female immigrant has a child.

The child is born here.

So the child is going to be, is a U.S. citizen.

They're entitled to some public benefits.

But in the explanation of the benefits,

maybe how the money was spent.

I don't know how officers are going get it to say it an abuse.

But they have something that they abused the public benefits.

And that's going to lead to problems

and an NTA and going to immigration court.

This one, people are going to have to be really careful with this one

because this is not uncommon scenario.

I really think, as I was reading this memo,

that more than ever,

immigrants are going to have to talk to lawyers.

They're not going be able to just go to notarios

and immigration assistants and

paralegals and their uncles and cousins.

These are some tough issues.

Another one that's mentioned in a memo is

a good moral character for naturalization applicants.

Imagine that.

You're applying for naturalization, and they say,

"Wait a minute, you did something that was a bad moral act years ago,

and so we think that should have precluded you perhaps

even from becoming a permanent resident."

An individual, I received a call from an individual,

who had been denied naturalization

and had received a Notice to Appear

which leads me to believe, just like the instance

from the woman that was actually referred to law enforcement at her interview,

leads me to believe that although this memo came out on June 28,

that the government has already been implementing these policies

at various offices throughout the country.

Which ones I'm not really sure.

But I do not believe this memo is just doing it now.

I think they're doing it even without, even before the memo.

So this individual said that

he had been denied citizenship, and I said, "Why?"

He said, "I committed fraud."

"Oh, what fraud?"

"They said that I didn't admit to smuggling in 1972."

And I said, "1972? Did you smuggle someone?

"No sir."

I said, "Well, then what happened?

He goes, "When I was coming across the border,

and I had my wife with me in the car."

And I said, "Okay, so what was your status?"

"I was a lawful permanent resident."

"Well, what was your wife's status?"

"She was a lawful permanent."

"Was there anyone else in the car with you?"

"My father-in-law."

"And what was his status?"

"He was a U.S. citizen."

"At the time?"

"Yes, there were only the three of you in the car?"

"Yes."

"And all three of you were legalized?"

"Yes."

"Where's the smuggling come in?"

"Well, as we were crossing, and they asked us for our documents,

my wife inadvertently said that she was a U.S. citizen

which she quickly corrected and said U.S. lawful permanent resident,

but we were sent to secondary and we spent about an hour there

and went through questioning and

that's all I can think of in 1972.

They wrote us up and it shows up as smuggling."

"And they denied your application because of that?"

"Yes."

"And so now you have to go to immigration court

to face the deportation charges."

Now, that case very well

could possibly fall under the issue we were discussing a few days ago

because I'm not sure that when USCIS issued him the Notice to Appear,

that it had the time and place.

And in fact, right now, the two memos that I'm discussing here,

actually,

they are on hold because the government needs more time to write

the implementing regulations for the offices to follow.

And because of that, I'm assuming that may be related to the recent Supreme Court case,

that they have to issue a date and time on the Notice to Appear.

Now, that's going to be a problem for them.

How are they going to get the date and time,

on the day of the interview?

Are they going to create a special hotline

with immigration courts where an immigration officer tells

the person at their interview, "Well, hold for a minute.

I've got to go to talk to my supervisor."

And then the supervisor gets on this hotline to immigration court

and they get a date and time.

They get it all set up, and then they come back ten minutes later.

Boom! They slap the Notice to Appear on the individual.

Is that where they're headed?

I'm not so sure, but that could very well be what they are talking about.

Now, there was a second memo

which follows shortly afterwards.

It's July 13, 2018.

For simplicity's sake I'm calling that

the RFE (Request For Evidence)

and Notice of Intent To Deny memo

because those were the two main issues

that were discussed there.

Now, how the two issues, how the two memos, connect,

there's still some speculation on that.

But I think common sense shows that

the second memo clarifies and tightens

the noose created by the first memo.

Let me discuss that. Okay.

The notice, the request for evidence, the way it's worked

when an individual goes to immigration court,

I mean goes to an immigration interview,

and the officer is going to deny it,

well normally the way it's worked is that the officer would send a letter

to the individual or give them a notice that they have

30 days in which, if they feel the decision is wrong,

to file a motion to reconsider or a motion to reopen.

And in addition, the person, if there was something small

that they could have corrected, that they really made a mistake,

they could also reapply again.

Now, the two new USCIS memos do nothing to change that.

USCIS, as I said, has always had the power to issue Notices to Appear.

They just didn't execute it because they were more a service-based agency

and they would hold back on that and give people

time to decide what they were going to do

before they would notify them of having to go to immigration court.

Now, however, it's going to be more instant,

and there are numerous situations where this could be occurring.

For instance, if someone applies,

let's say, someone applies for adjustment of status for a green card

through marriage to a U.S. citizen

and the U.S. citizen doesn't submit

a certified copy of a divorce to a former spouse.

Well, now instead of a request for evidence,

that can be the basis of a denial outright

because that's something that should be in the initial package

and should be given to them and

without that, you know, USCIS officers may be

instructed now to interpret that as a sign

that they don't have it,

that this is an indicia of immigration fraud.

How about an individual who submits financial documents

and they don't quite meet the level of support

for their spouse that they should have,

or they forget to submit

the proper tax returns or recent check stubs or something.

That could be a basis of a denial.

Or maybe a death certificate of a former spouse,

or maybe even a marriage certificate

or the birth certificate is not translated from another country.

Is that now going to be the basis for issuing

a Notice to Appear in immigration court?

It very well could, given the emphasis of this administration.

In the old days, the policy was,

if there if there is no possibility

of the individual to correct this error,

then they issued a Notice to Appear.

Now, that's been totally stripped,

so it's not whether there's no possibility.

It's whether, is there an error, is there a mistake,

is there a ground so we can get them to immigration court?

And what this does is it cuts in the individual's right to defend themselves.

Imagine an immigrant spouse, who,

someone comes in on a tourist visa,

then they fall in love and they file papers.

But now when they get sent to immigration court,

they're going to be, that time could may be counted as unlawful presence

and because, look, immigration courts are already,

already overburdened. Okay.

We know that at least 700 thousand cases

are backlogged in immigration court.

So add how many more, a hundred thousand maybe,

maybe more? All of a sudden you add that to the immigration court,

so now someone is going to be facing

and they can't leave without incurring a five-year bar

and if they stay here they might go from a three-year bar of unlawful presence to a

ten-year bar - because now they've been here instead of 180 days,

three-year bar, they move over to 365 days.

That could be what happens to them,

and that's a real, real, real issue that immigrants have to be worried about.

Imagine, too, that the 601A waivers,

when someone applies to show hardship

to a qualifying relative, to a spouse, so that they can go to the interview abroad,

and they're denied that.

Well, in the past, that hasn't led to a Notice to Appear.

That hasn't led to being forced to go to immigration court.

Well, now it very well may.

And how about a basic immigrant petition, an I-130?

A child over 21 who is a citizen files for a mother,

and there's something wrong in that application,

and it's denied.

Well, they know now, right,

that the mother is here without papers?

Is that going to lead to her being sent to immigration court

as an undocumented immigrant?

I was at a recent naturalization interview

and the officer was questioning my client

about a previous citizenship application she had submitted

that was denied several years before,

and it was denied and they went to her house

and they inspected her. She was still at the time living with her husband.

They were living in separate rooms.

They had mentally checked out.

But they were a couple and maybe they were going to get back together.

But it was well after she had cleared the conditions on her green card,

as well as after she had been a permanent resident four or five years.

She didn't need her husband in order to apply

for citizenship at that time.

Whoever helped her marked the wrong boxes. She was denied.

So we're at this interview

and they're questioning her on that.

My simple question "Why are you questioning her on the old fraud,

if you think it's a fraud?"

And they said, "Well, he wasn't denied as a fraud."

And I said, "I know that because I've seen her records.

What was it denied on? It was denied on a suspicion of something, correct?"

I said, "But look at the dates."

I said, "Is there anything that when she came in on a fiancé visa,

was she denied?

No.

Was it based on when she got her conditional green card?

No.

Was it based on when she was given her green card?

No.

It was at a citizenship interviews years later

because they said that she wasn't with her husband.

Yet she had already exceeded five years as a permanent resident.

She didn't need that. It was misfiled and your records are wrong."

Now, if I had not been there?

She would probably have received an NTA.

That's the danger of what's going on with these memos.

They're going to be placing so many individuals in immigration court.

Look, here's my view.

You're going to need a lawyer

even for the simplest of filings.

You can't take the chance of someone

not filling out your papers correctly,

not knowing what's required,

and for a lot of clients,

for a lot of immigrants, you got to slow down.

Sometimes it takes a while to put that package together

completely in an orderly manner.

You've got to give your attorneys and the paralegals time.

You've got to give them time to do it correctly,

especially now, because that quick ride,

that quick motorcycle ride to a green card

that you're hoping for

may be a slow boat to immigration hell.

You don't want that and so with that,

I am going to close this discussion.

And I really want to encourage you to keep an eye on these policy memos.

The policy memos are not in full effect yet.

They may very well go into full effect any day.

Hopefully, they never go into effect.

But in any event, immigration can still,

or USCIS can still, implement a lot of these policies

because it is in the scope of their authority.

I do wish you the best.

I really hope you're super careful.

Don't procrastinate seeing someone that can help you.

Don't delay.

Don't omit stuff.

Tell the truth to whoever helps you.

And be very, very careful.

STOP Asking For OPINIONS! They DON'T help your photography! - Duration: 7:39.

In this video I am going to show you what happens when you ask for opinions about your

photography and I'll explain what you should be doing instead.

Hey gang!

Stop asking people what they think about your photographs or what they think you should

do to improve - just stop.

It's not helping you - in fact it's making it harder to progress and improve as a photographer

because frequently the opinions that you get influence your future decisions and make you

doubt your own creative instincts.

I recently did a little social experiment with two glamour headshots from a test shoot

that I did with a beautiful young model.

Stay tuned till the end and I'll share the behind the scenes of how I created theses

shots.

This was an experiment designed to get good engagement - in other words - lots of comments

and lots of opinions.

I have a very clear favorite between the two and I'll only use one of them in my portfolio.

I'll tell you which one in a minute.

I posted both of these images in 32 different Facebook photography groups that are dedicated

to topics like portraiture, fashion, mirrorless cameras, micro 4/3 format and Olympus.

I also posted them to my Facebook business page, my personal page and in my own TOGCHAT

LIVE Facebook group.

Along with the images I shared this behind the scenes shot to add some value by teaching

people how I did the shots - and I asked this simple question…

Which do you prefer - and WHY?

So what happened?

I got a great response - over 1,100 comments were posted.

There were about 15 comments that didn't make a selection but made it a point to tell

me how much they hated the photographs.

There were another seventy or so comments where people didn't express their preference

but told me things like if I took the hair from one shot and put it in the other - then

they would like the photo.

The remaining comments split just about 50/50.

The people who like the first shot commented consistently that they loved the model looking

directly into the camera and the almost startled expression.

Many people mentioned liking symmetry in a photograph.

This group often complained about the second shot saying that the messy hair on the models

arm was too distracting.

One person explained that the messy hair made him want to itch!

Overwhelmingly people complimented the beautiful model.

The other half who picked the second shot loved the leading lines and the models expression.

This group frequently complained that the model looked stiff and lifeless in the first

photo. and the list goes on.

So the result: the post was very successful at engagement and even some new followers.

But as far as learning anything about my photography - what did it teach me?

Nothing.

It was basically a 50/50 split with comments that made it clear that different people have

different tastes and opinions and there is no way to satisfy everyone.

Kind of like politics.

And there lies the problem with opinions….

The people who gave me their opinion didn't have the same experience with the subject

as I did and they don't have the same emotional attachment to the shot as I do.

Think about it - did you pick up a camera for the first time because you wanted to impress

someone?

Or because you wanted to create and record the moments of your life?

Science has taught us that knowing the opinions of others will impact our decision making

process and often times not for the better.

Opinions hold great influence especially when they come from someone who we respect.

Unfortunately opinions usually lack context - an understanding of the circumstances and

choices and opinions rarely offer solutions - they are just a shallow snap judgements.

History has also shown us that the most creative among us are the ones that are brave enough

to ignore opinions and the judgement of others and follow their own inspiration - wherever

it may lead them.

GREAT Photography is not about being right or wrong.

My favorite shot BTW - #1.

I'm proud of both shots - but the first one is what I had in my mind when I set up the

fans and I love the eyes staring right back down the barrel of my lens - and yes - I am

a big fan of symmetry.

I did a similar social media post with these two photos.

People overwhelmingly picked this first shot and just like the other photos offered plenty

of ways that I should have done them differently.

My favorite…

The second shot.

I love the chaos of the red balls and the calmeness of the model in the center.

Even though people overwhelmingly picked the first one - this is the shot that I will use.

Don't ask for opinions and learn to take them with a grain of salt.

If you want to have success as a photographer you have to learn to live and die by your

decisions and you have to learn that NO other person will have the same experience with

your photographs as YOU do - and that is ok.

BTW - success as a photographer simply means achieving your goals.

Those goals may be just having the ability to produce great family photos or they could

involve being able to pay your bills with a camera and work as a full-time photographer.

The bottom line - it's about doing what makes YOU happy.

Photography that YOU are passionate about in the way that you like to view it.

If you are thinking about turning pro and want to build a following or get more customers

- you have to shoot what you shoot - the way you like to shoot it and do it to the best

of your ability and then find the people who like what you do and who are willing to pay

for it.

Not every one will.

I promise you there are a lot of people who think my photography sucks.

And that's ok!

Both of these shots are simple one light portraits.

I have my model placed about 3 feet in front of a Savage Universal Thunder Gray Seamless

paper backdrop and I am using one Interfit Honey Badger with a 28" Studio Essentials

Beauty Dish with the sock in place.

In case you are wondering - a sock is a cloth diffuser with elastic sewn in the edges that

you can stretch over the face of a beauty dish to soften the light.

I have a white foam core reflector underneath the model for a bit of fill and to add to

the catchlights in her eyes.

The vertical white reflectors that you can see in the background - are really not impacting

this photo at all.

They were left over from a previous shot I did and I just moved them out of the way to

do the blowing hair.

One fan is placed on the floor behind my subject and it's aimed straight up which blows her

hair up and forward.

The second fan is in front of the model to help blow the hair of off of her face.

I always have my makeup artist or an assistant along side the model to help manage the hair

while I'm shooting.

Here is a third version that I also liked - but not as much as the first two.

I hope this video makes you think and more importantly empowers you go and have FUN and

Is HCJustin a Communist? (Turn CC on) - Duration: 16:54.

Hello everyone, I am URaelms and welcome to my new video.

Today we're going to take a look at Urealms cast member and popular Twitch Streamer HCJustin.

Rumors have been circulating about HCJustin being a Communist, or otherwise an extreme

authoritarian leftist.

Being an investigative reporter, I have taken it upon myself to see whether these rumors

are true or not, and to publicize my findings in this video.

This channel is dedicated to independent journalism, so I tried to keep my investigation as objective

and unbiased as possible.

While I may personally be a big fan of HCJustin, my opinion of him remains second

to finding out out the truth.

I began my investigation by browsing HCJustin's twitter page.

While not the most elaborate start, it did immediately show me warning signs that the

rumors were accurate.

It didn't take long to find this tweet, implying that HCJustin is left-wing, much like a Communist.

In fact, HCJustin's tweets and likes are so overtly left-wing that if I stopped to examine

every one of them, this video would be 147 minutes long.

Instead, watch as they pass by and know that these are just a handful of thousands out

there now.

While all Communists may be left-wing, being left-wing does not explicitly confirm that

someone is a Communist.

And while someone who is secretly a Communist may only be comfortable sharing their milder

viewpoints and opinions, they would be indistinguishable from an outspoken moderate,

especially if said moderate was constantly at odds with the right and not with the far-left.

In other words,

fire produces smoke,

but no matter how much smoke you have,

it is not undeniable proof that there's a fire nearby.

I needed more evidence.

It took some digging, but eventually I did find some damning evidence against HCJustin.

One man jokingly suggests eating the rich, a common phrase used to make fun of Communism

and the great famines it leaves in its wake.

No food?

No money?

Just eat the rich!

However, HCJustin's enthusiasm overpowers his social awareness and he goes on a tirade,

proclaiming to all that were he in charge, anyone successful to be rich would be slaughtered.

Clearly, he didn't get the joke.

But HCJustin's bloodlust doesn't stop there.

In this tweet, he reveals that he not only supports killing the rich,

but also killing anyone who disagrees with his economic policies.

On top of that,

in this tweet he literally admits to being a Communist.

All of this evidence does in fact point toward HCJustin being a Communist,

but still, some things don't make sense.

For example,

in the 2016 election HCJustin voted for Hillary Clinton,

and expressed great distress when Donald Trump won the presidency.

HCJustin claims to be a progressive, wanting social change such as socialized health care

and education...

Yet Hillary Clinton stands for none of these things,

and when she rigged the Democratic primary against the actual progressive candidate,

Bernie Sanders,

HCJustin voted for her anyway.

Rigged the primary, you ask?

Surely that can't be true!

Though don't just take my word for it, just ask Senator Elizabeth "Pocahontas" Warren!

So why would HCJustin vote for the candidate that ruined the chances for the actual progressive?

Why would he vote for the candidate that pledged to increase interventionism in Syria, killing

thousands of innocent people and potentially provoking war with Russia to secure Syria's

oil?

Why would HCJustin vote for the candidate that was opposed to gay marriage until 2013,

that only changed her mind when it was clear which way public opinion swayed?

The candidate that is surrounded by numerous political scandals, up to and including murder?

You might think that HCJustin is just a hyper-partisan idiot with no critical thinking skills whatsoever,

and that he just votes Democrat no matter what.

That he's someone who unironically believes that Democrats are objectively smarter

than Republicans...

but that doesn't make sense either.

If you've paid close attention to HCJustin, you would know that he often says he plays

the part of an idiot for laughs.

If you look closely, you would see that HCJustin is actually extremely intelligent.

From his high-brow sense of humor involving everything from funny numbers such as 311,

the weed number,

and the sex number,

to his hilarious anecdotes about cum,

he definitely appears to be smarter than he's letting on.

Not to mention his amazing performances in URealms Live.

How could someone with such a shallow, black-and-white world view

give us such captivating, nuanced, and relatable characters,

such a Young Ladyir and William?

HCJustin's generic uneducated liberal persona all comes off as artificial.

Could he, much like Hillary Clinton, and the majority of Hollywood and popular culture,

be feigning his political alignment to attract the largest following possible?

Actions speak louder than words,

so let's take a look at HCJustin's actions instead of his words.

HCJustin voted for Bernie Sanders in the 2016 Democratic primary.

He believes that you are entitled to

free food,

shelter,

and weed,

even if you do not contribute to society in any way.

This makes him a Socialist.

However, he also voted for Hillary Clinton.

Clinton's support for American imperialism, to sacrifice the lives of potentially tens

of thousands of Syrian civilians, including children, in exchange for a Syrian government

willing to sell oil to the United States instead of Russia selfishly puts the needs of the

United States over morality and basic decency.

HCJustin's support of these policies, policies that put the needs of the U.S. over the needs

of the world, reek of Nationalism.

It is apparent that HCJUstin is also a Nationalist.

So, if you look at HCJustin's actions as opposed to his words,

it appears that he is a

Or a Nationalist Socialist.

Or a...

Oh...

This is all speculation of course, but it is not outside the realm of possibility that

HCJustin is secretly a Nazi genius who is hiding his true motives until an undetermined

time.

HCJustin does appear to have some fascist tendencies.

In the Wikipedia article on fascism, it says fascism rejects assertions that violence is

automatically negative in nature and views political violence, war, and imperialism as

means that can achieve national rejuvenation.

HCJustin has been shown supporting the politically violent group,

ironically named ANTIFA, or anti-fascists,

who are less like their name might imply and more like ignorant vandals

who accomplish their goals of being seen like superheroes by beating up the bad guys,

which isn't quite the same in real life as it is in the movies for a multitude of reasons.

HCJustin's support for political violence is a trait he has in common with Nazis and

fascists in general.

Though let's not be too hasty.

The term "Nazi" has been used haphazardly in the past few years and has lost almost

all meaning.

It has been applied to everyone from conservatives, to people that don't want to live with refugees,

to people that advocate for the right of free speech, to anyone right of center-left.

Therefore, I will sticking strictly to the dictionary definition of a Nazi.

To rephrase, in order for HCJustin to be classified as a Nazi he has to

1) Advocate for totalitarian government,

2) Advocate for territorial expansion,

3) Be Antisemitic, and...

4) Believe in the supremacy of the Aryan race.

HCJustin is pro-territorial expansion, as shown by his support for Hillary Clinton and

U.S. interventionism in the Syrian civil war, and while worldwide military interventionism

doesn't expand the land mass of the United States,

it does install regimes in foreign countries under control of the U.S. empire,

which is the meta of military conquest in the current year.

He is also pro-totalitarian government as shown by his support for Socialism/Communism

and his intolerance of both conservatives and free speech.

He even supports arresting and censoring anyone who makes fun of Nazis, which, as we all know,

is a common trait of Nazis.

But what about the other two?

Well, I have found that there is evidence of HCJustin being a white supremacist.

Just listen to this witness testimony from one of his viewers.

Now, let's analyze this.

HCJustin referred to a fully grown African-American man as boy.

From Wikipedia:

So not only did HCJustin use racist language to demean an African-American,

he also shot him to death in cold blood.

If there's a more blatant case of racism, I haven't seen it.

Therefore, we can cross 'believes in Aryan Supremacy' off the list.

Lastly, Nazis are openly anti-Semitic.

You might think that HCJustin hasn't said or done anything openly anti-Semitic,

but you would be wrong.

Not many people know this, but HCJustin consistently references and endorses anti-Semitic media.

For example...

HCJustin often does impressions of Borat Sagdiyev, known colloquially as Borat.

He often uses Borat's catchphrase "my wife",

and even owns the domain boratvoicemywife.com,

which redirects to his Twitch stream.

Rather than go through every case of Borat's rampant Antisemitism, I think it would be

more compelling to show you one example of hundreds.

HCJustin openly supports someone who publicly and melodiously

called for the mass extermination of Jews.

In my opinion, that is grounds enough to accurately refer to him as an anti-Semite.

So far we have proven that HCJustin is pro-totalitarian government, pro-territorial expansion, anti-Semitic,

and an Aryan Supremacist.

As these are the four qualifications for someone to be labeled a Nazi,

we can conclude that HCJustin is a Nazi.

Now, after learning this piece of information, I encourage you all to be civil.

Just because HCJustin is a Nazi,

and HCJustin has also advocated the use of violence against Nazis,

does not mean that you should sink to his level.

Do not run up to HCJustin at a convention and punch him in the face,

even if it would get you virtue points and make you e-famous.

Punching HCJustin won't make him any less of a Nazi.

It will only make him grow even more resentful, more likely to make him feel justified in

using violence against others, and possibly martyr him.

Don't contribute to the escalation of politically-motivated violence in America.

Don't be like HCJustin.
